car accident personal injury HELP

hi wondering if any body can help me 5 weeks ago i was in a car accident i was driving with my partner passenger and daughter in the back.There was a car stopped on the road and i stopped behind her as there was cars coming down and i couldnt pass when a car hit me from behind spinning me round hitting the car that was stopped and one of the cars coming down hit into me as well all for cars are a right off we was in a 40mph limit bt i dont think we was hit at 40mph, any way i was the only one hurt in accident with my face hitting steering wheel as airbag didnt come out i was taken to a&e by ambulance with suspected broken nose and my teeth had gone through my lip and out the other side.i had to get the inside of my lip stitched and they glued the top and underneath and lucky enough my nose wasnt broken they told me i had whiplash and it should clear within a few days. next day very very sore swollen/bruised face and very sore neck and shoulders yes within 5 days pain from shoulders had eased but neck still sore went back to doctors who said i had bad whiplash and gave me more tablets after another 2 weeks i returned to doctor still within pain and stiffness in neck doctor sent me for xrays again so waiting on results my question is the girl who hit me from behind insurance is harrasing me daily by phone wanting to come out to my home and settle me with my excess,for my car and personal injury i have told them to deal with my insurance but still they phone. i only had my car a matter of weeks when the accident happened and my insurance has gave me a very poor offer for it they havent even gave me book value considering she was mint with low miles and many extras
sorry for going on but this is the first accident i have had and i dont realy now what to do and my insurance isnt the best for help it is now 5 weeks since accident i am still off work with whiplash and i have 2 scars to my face lip and have lost the feeling to my bottom lip any information wold be a hepl please

    If you've only had the car a few weeks then the insurance should pay out what you paid for it. Contact them and refer them to http://www.financial-ombudsman.org.uk/publications/technical_notes/motor-valuation.html particularly point 9.

    On the personal injury front, I'd be inclined to get a specialist lawyer on it. As liability is clear cut then you should have no shortage of no win no fee companies queuing up to take your case, some will even give you cash-back for letting them do it. They'll sort you out replacement car if you can't afford to hire one, will organise the medical reports and advise you of reasonable settlement figure etc

    Oh and you wont be claiming from your insurance company for your car, it'll come from the 3rd party.

    hi thanks for info i had car 8 weeks i paid £10500 book value is £9200 standard without the extras,my insurance offered me £8000 the third party insurance keeps phoneing me offering to settle for my car,excess and my personal injury but my insurance tells me not to talk to them i do have leagal cover with my insurance and the third party has taken full liabilty should i answer the other insurance as i dont want to loss that much money with my car they told me they would give me a better offer for it but the way i see it is my insurance will be claiming from them anyway for my car am i right in saying thanks again for info x
    me and my partner only had the courtsey car 6 days and they took it back as they had made me a offer on my car which i refused now i have no car no money to buy one with

    I think my previous post answers all your questions, just google to find companies that will give cash back and phone a couple of them in the morning, pick one and let them do their job. I'd be surprised if you didn't have a hire car by lunchtime

    Claiming directly from the other party for the actual vehicle replacement cost would not be a good idea. This is because they will not be obliged to follow the Ombudsman's guidance which could be crucial in increasing the offer (See Viao's link). However the OP's own Insurer will be obliged to follow the Ombudsman's guidance / rulings
