IB stopped - What can be claimed

Hi

after reading vearious articles on the formum, can someone clarify this for me ? My friend has just had her IB stopped and we have already asked for this to be resassessed by a decision maker and will go to appeal with it but can she still claim IB until all has been sorted out or ESA whils going to appeal. All we have been informed of is that she can only claim IS at 20% less than normal but we are now confused as to go forward to help her.

Thanks

Don't worry about marc777, if you have a look at his other posts you'll see he is just a big old troll.

The information you have is correct, she can claim a reduced rate of IS or she can put in a new claim for ESA. However, she is likely to be called for a medical very soon if she claims ESA. Has she submitted further evidence in support of her appeal?

Yes , we sent the appeal form on Friday ref all that actually took place at the interview, have seen her doctor who has noe put her back on even more powerful drugs, seeing the pshyciatrist on Tuesday , asking for a letter off the doctor to send and possibly psychiatrist letter. Also phoning for a social worker tomorrow as all of this paperwork, etc has gotten too much for me.

I would definitely get a letter from the psychiatrist. They will have dealt with this situation before, and will know what to write. Having said that, if you don't think that they have given enough detail, don't be afraid to ask them to add/ edit their report. After all, the claimant knows their condition better than any clinician.

    (Excuse the alliteration!)

If ESA is claimed it will be a fresh claim within six months and wont go into payment straight away.
