Redundancy Notice Period Changed When Company Sold?

Hi, apologies if this question had been addressed already but I can't find anything in previous threads.
I've worked for my company for just over 4 years and am being made redundant :-(
I've been told I get one month's notice (which I have to work), plus 4 weeks redundancy payment which seems to be the statutory requirement.
My original contract just says 1 months notice applies on either side but doesn't mention redundancy at all. However, the standatd T's&C's of the organisation which owned the company at the time were 4 months notice when dismissed by reason of redundancy.
The company changed hands the year after I was taken on. I received a letter saying that my terms and conditions hadn't changed. I was given a new contract but it was essentially the same, it still just says one month notice and makes no specific mention of redundancy.
I was under the impression that I was still entitled to 4 months notice. I've queried this with my manager but not yet had a response. If anyone has any idea as to whether I am on solid ground with this it would be gratefully received - having seen how the current owners have treated other employees in the past I don't want to get into a battle with them unless it's worth it!

  • They are probably giving minimum redundancy notice required by law, depending on your age.

    You have done the right thing by questioning the notice but my understanding is that 1 week per year of service upto a total of 15 (my partner was with his company for 22yrs but only got 15 weeks paid redundancy + 15 weeks notice = 30 weeks pay (notice was taxable but redundancy pay was not). His company did a 90 day consultation thing, then told them all they were being made redundant.

    You could phone ACCAS they are good.
  • I believe you will find that, if you were TUPE'd over to the new company, your original contract will apply. If you have the original contract which shows the redundancy notice of four months then hold out for that - but it sounds as though that would be worked notice.

    Statutory notice is one week per year up to 12weeks and not age dependant.

    Statutory redundancy upto 20 years service, working backwards from termination date for each full year 1week per year up to 41yo and 1.5 weeks per full year over 41.

    statutory redundancy is capped at £380pw an enhanced policy can use other rules as long as it gives at least the statutory minimum.
