If he has over £16,000 he will not get means tested benefits.

SDA isnt means tested, it was given to people who hadnt paid the required NICs for incapasity way back when I first claimed IVB, I dont know the year it finished but I claimed IVB is 1992.

While SDA isnt means tested is it not the case that Pension Income affects it?

I've never worked with SDA so dont know the answer to that.

Pensions dont affect my IVB and I believe its the same for SDA.

I get SDA, and have done since 1997.When I got to retirement age, I got my forecast from the DWP, and I was only entitled to £32 per week, as I had only ever paid married womens stamp.I was told that my SDA would stop if I took my pension, but was given the choice of keeping my SDA instead of the pension, I opted to keep SDA, as it was more money. The reason they gave me was that they are overlapping benefits. I still don't understand it TBH, but the paperwork said that SDA ceased when pension is in payment.

Benefits for people with a disability or caring for a disabled person

If you are disabled, you may be able to claim benefit for the extra costs of your disability. This will depend on your age and other circumstances. If you look after a disabled person in their own home, you may be able to claim Carer’s Allowance.
If you are already getting benefits because you have a disability or look after a disabled person, some of these benefits will be affected when you reach state pension age. For example, you cannot get Incapacity Benefit once you are five years over state pension age and you can't get Employment and Support Allowance (ESA) when you reach state pension age. If you are getting Carer’s Allowance or Severe Disablement Allowance, this will be affected by any State Pension you get.

because your SDA was going to be [STRIKE]lower[/STRIKE]higher than your State Pension, so you can keep the SDA instead of going over to SP. Some people get SP topped by SDA to the level that they were getting with SDA. If you had been in IB that would not of been an option.

sorry was still in work mode!

The SDA was higher than my state pension. The forecast said SP was £32, and my SDA is £67 per week,so I get that instead.

My pension is a private pension paid out under the disability rules and not SP, IB and ESA have a pension disregard of £85 pw with IB/ESA reduced for any pension paid over this, IVB allowed any ammount of pension to be claimed without it affecting the ammount payed.
