Car fault

i purchased a mercedes c220 from a local used car dealer in newcastle in july this year.

i'm just awaiting it coming back from a garage as the high pressure fuel pump has had to be replaced.

now this isn't the only fault with the car, the passenger side door lock is "bouncing" and as such needs a replacement.

the car only came with a three month warranty, obviously this is now out of warranty but i'm sure i remember hearing something along the lines of if the fault has occured within six months then the onus is on the dealer to prove the fault WASNT there at the point of sale.. otherwise they are liable for the cost of repair.

is there any truth to this, or did i just dream it?

thanks

Lance

Mercedes have been way off the mark on build quality now for over a decade, it's not special because it's a Merc and as far as I know once out of warranty that's it, unfortunately :(

Agree about the build quality, my neighbour has a new one and seems to have nothing but fuel/injector related problems, 4 failures that I know of and it’s only just a year old.

As for the warranty issue, once it’s finished that’s it but as you correctly remember Sale of Goods does have merchantable quality requirements and the general principle is that fault becoming apparent in the first six months are assumed to be present when it was sold unless the seller can prove otherwise.

Having said that there is also a reasonableness bit in there so what you can expect in terms of quality varies depending on what you bought and what you paid etc etc
