this might be a stupid question but can ebay charge VAT on a sellers item which is 2nd hand as ive been charged full vat on 2nd hand phones ive sold and have never passed on the vat to the buyer,. after all how could u when ebay add vat after the sale

Sorry your question is confusing.
You can only charge VAT if you are registered for VAT and it is a VATable supply or service.
If you are not registered for VAT and you buy say phones and are charged £10 + vat = £11.75 and you sell them on you sell them for £11.75. The new buyer if they are registered for VAT and can claim back VAT cannot claim the VAT back on this item as no VAT has been charged by the supplier i.e. you. You can only claim back VAT if you have a VAT invoice complete with valid VAT reference number. Any business turning over £58k per year has to register for VAT.

thanks for the reply,. i think im getting confused with the FVF and thinking that is vat,. ill have too look at one of my old ebay invoices0

Obviously VAT is due to (and charged by) ebay on their fees, irrespective of whether the item is second-hand. And if you buy second-hand goods from a VAT registered supplier, they'll be subject to VAT. But if you buy or sell privately and the seller is below the VAT registration limit, no VAT is chargeable on the item itself.0
