Hospital parking fine for staff

I am a registered theatre nurse working at a hospital in the South of England.
I pay £20 a month deducted from my pay for a parking permit this does not guarantee me a parking place even in the staff car park.
Depending on shifts/training etc I may have to park in the visitors car park area. I have been told I must pay the charges as pay and display this may be up to 12 hours depending on my shift. If not I could be fined, one staff has recently been clamped whilst working on the wards.
Therefore the questions raised are:
Do I have to pay the pay and display?
If i am paying £20 a month for parking does that not cover my parking? (There is no rebate if on holiday.)
Are the fines enforceable?
The private firm is contracted by the hospital who seems to let them do as they please. At times the parking enforcers are unhelpful when you put forward concerns/problems. They say its not their problem there are no parking spaces if my shift does not fit in with the spaces available.
Also a side issue. The parking permit which we are given displays our names. With recent events of nurses being attacked in car parks/stalked etc I feel this is unecessary. I asked why not issue numbers to correspond to names on a computer. i was told they need the name so they can find you if your car gets "bumped". I said I would put the extension number of my dept instead of my name. i was told that meant the parking permit was not valid and i would be fined. What of data protection etc?

Go to your union and get them to help. If its a definite break between hospital and ppc then just ignore them.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

Get in touch with your Information Governance people, they will, or should, most definately have something to say about your name being on the car pass. It shouldn't be therePrivate Parking Tickets - Make sure you put your Subject Access Request in after 25th May 2018 - It's free & ask for everything, don't forget the DVLA0

If your employer is charging you for parking and not providing a space [or a refund if there are no spaces], then get on to your union.
Ignore the parking company. Private companies cannot issue fines, just invoices that can be ignored.0 -
Don't forget there was mention of clamping. It will soon be illegal on private land, I wonder if some of the cowboys out there would try contest that NHS property is NOT private land?0

We have had several threads about Hospital staff getting these unenforceable charges this year. It really is shocking, do not pay it.

Basically if a private company wanted to try to enforce a parking charge they have to take the person to Small Claims Court and show breach of contract against the driver (very difficult for them to prove). It's so rare that a PPC ever go that far it's almost unheard of, and Trethowans Solicitors have tried just a few cases for NHS Trusts and have lost in Court.

Unfortunately this is quite common. I used to work at Newcastle University and at the time (changed now) they charged £66/month for a parking permit. But that didn't guarantee you a space - in fact I had to arrive before 7.30am each morning or there would be no chance of getting a space. No refunds if you can't get parked!
I've since left but they've changed now to a P&D system so at least you don't have to pay if you can't park.0 -
I fully agree with speaking to your union. I would also make a formal complaint about the "necessity" that your name be displayed on a permit. The company's attitude is arrant, ignorant nonsense.
As far as the car park management issue is concerned, although you have indicated that the hospital employs them directly you may well discover, with a little research, that a facilities management company sit between the Hospital Trust and the car parking company. This will probably have complicated the passing of the necessary legal rights to the car parking company sufficient for them to be legally able to charge for overstays/failure to display permit etc etc.
Whatever you do do not pay them.My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).

You can also hit them with a Freedom of Information request. AS a Trust employee I would recommend that you do it via email. I leave it to you as to what name you use but do not use D Duck as they may well refuse that. Disgusting that a public body such as an nhs trust associates themselves with these companies, its nothing but a tax on the sick, their visitors and the staff who look after them, they should be named and shamed !
NHS trusts in Scotland & Wales are free to use for the above, but what is despictible is that the BPA wants to force the assembly and scottish parliament to change free parking so their members can go in and scam the ill, they are beneath contempt !Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!
Do you really need to ask what kind of people run parking companies?0
