Hello all,
I was stopped by two pcs today, and was charged with using the phone whlist driving yes i was on the phone wth my husband, but my car is fitted with bluetooth handsfree (parrot),and i really cannot be using the phone and parrot together, b/c the phone is connected to the radio system, which overides everything. l informed them of this that i was not holding my phone, but still gave me £60 with 3 pts. They told me they saw me holding the phone, and a member of the public pointed me out to them. I really want to context this, but am afraid it will be my word against them. I am also worried that, if l lose l might incurred higher charges, another pt is the police did not ask for my phone details, what is the implication of that.

Thanking you.

Feel free to contest it but I suspect when it goes to the magistrates court he is going to take the word of 2 members of police force over an individual who admits they were talking to their husband on the phone while driving.

If I am stopped by a policeman and charged with driving with my fog lights on or a bald tyre they don't have to have any evidence of the offence, their word is considered proof enough.
