Underpayment - Wrong Code for 5 years!

  • No, if HMRC have not issued a code to replace the 973T one, then you need to claim under ESC A19 - HMRC failing to act on information available. Its not your employers job to check that your code is right (in fact in my Inland Revenue days we would get nosey payroll clerks rinigng up about code numbers and we would give them short shrift).
    HMRC may well argue that its your job to check your code is correct (and this is the case) and you should have known you were getting WTC through your code and as a cash payment, but its worth a go.

    The first instance I've found of the code appearing is on my P60, certainly not filled in by me, or HMRC - but presumably my employer or their accountants??
    Knowing nowt about tax codes, I assume this code was issued by HMRC to them and they input it onto the form?

    Is there any other topics with regards to the Tax overpayment and finger pointing?? I am at work at the mo but will check back when i get in have a look through all threads. I am in a role where i have thousands of people effected by this (not HRMC i may add) and could give some advice!

    That's the preferable route. As it presses HMRC into saying (you didn't find the P2) if they ever issued (your 1st post implies not) that code. If not they will need to check with the employer where it was conjured up from.
    If you want to test the depth of the water .........don't use both feet !

    Unfortunately I've sent off a letter implying that in my opinion my employers accountants hadn't brought the matter to my attention, therfore it was as much their fault as mine:( I thought the ESC A19 route was more for self-employed or those with pensions.

  • No, ESC A19 applies to all taxpayers.
    In using this, you allege that HMRC were told that our code number was wrong and failed to correct it. That information about the code being wrong could only come from you as it is based on your personal circumstances. Your employer uses the code it is told to by HMRC until HMRC tells them to change it - its not their job to query it, but yours.
  • got an email from hmrc saying i had a tax rebate...had to give bank account details to get the money paid in. I didnt go there ..has any one else had these?

    Yes - lots. They're called phishing Emails.

    I would panic if you put your correct details in!.
    If you want to test the depth of the water .........don't use both feet !
