Stunned - parking officer lied

I'm so angry - on tuesday my pay and display ticket ran out at 14.32, I was stood at the machine at exactly 14.32 about 6 spaces away purchasing another ticket when I noticed the attendent taking photos of my car, I tried calling him as I was running towards him waving the ticket I'd just bought - he just looked away and started to take photos of the road signs. There was no ticket on the car and I showed him the new ticket and asked him if he intended to give me one (he was showing no sign of being about to print one) and he said that no he wasn't and I was ok. I put the pay&display ticket on the car and left it there and walked back to work.

Today I got a PCN from the council saying that a civil enforcement officer had observed my car from 14.32-14.35 and had begun to prepare a ticket when I jumped in and drove off - this is a blatent lie, the car was there all afternoon until 17.30 and I still have the ticket covering me until 17.30. The two photos they have included are just a blur of the ticket that was stuck to my windscreen.

I'm so angry and stunned that the attendent would just lie like that,
I will be looking out for him tomorrow to give him a piece of my mind but I was wondering if anyone could help me with the wording for my challenge/appeal.

    First of all, we need to see the ticket - the whole ticket, front and back. And any signs and lines. If you are going to appeal, then you need to throw everything at them. The wording on the ticket and any signs is vitally important; the council must make any mistakes (but many of them do).

    I would hazard a guess that your ticket was purchased at 14.30 so that it expired at 17.30? What I am thinking is even if there is a minute unaccounted for they may enforce the PCN. If there is no time unaccounted for then IMO you need do nothing in your appeal other than state the plain simple facts which are true and that you can back up with documentary evidence. Enclose photocopies of the tickets, do NOT send the originals as they will mysteriously go missing. If there is no time unaccounted for the Council would be stupid to take it further.

    I would recommend against harassing the warden. Yes he is the scourge of the earth and lying scum, beyond asking him why he lied (to which he will answer he didn't lie) I can't see what you can say and do that won't encourage him to call the police on to you (which may actually be worth it as the Police won't really act).

    Thanks for the replies - just reading through martin's guide to appealing and I think I have 3 grounds for appeal.

    1. The alleged contravention did not occur. Additionally, this ground applies to those who were buying a pay & display ticket, or who were on the way to buy a ticket when their car was ticketed.

    2. The Penalty Charge Notice was served by post because the council say the Civil Enforcement Officer was prevented
    by some person from fixing the Penalty Charge Notice to the vehicle or handing it to the person in charge of the vehicles, but this did not happen.

    3. There has been a procedural impropriety by the Enforcement Authority - on the list of reasons it gives one of them is 'If the charge is not paid within 28 days, a 'Notice to Owner' form will be sent to the vehicle owner.' - my letter doesnt appear to mention a 'notice to owner' just says that 'if after the last day of 28 days beginning with the date of this PCN is served no representations have been made, and the penalty charge has not been paid, we may increase the penalty charge by 50% to £90.00 and may take steps to enforce payment of the increased charge.'


    It was bay parking on a street, not spotted any cctv there but I really hope there is - will check tomorrow.

    I doubt there will be a minute unaccounted for between the tickets, maybe one minute but not three.

    The thing that's quite upset me is that I'm 7 months pregnant and was actually running up this hill waving the new pay&display ticket at him and he was just ignoring me, told me I was ok and he wasnt giving me one and has blatently lied - still want to give him a piece of my mind tomorrow if I see him - gggrr.

    Hang on a minute! Show us the ticket. The exact wording is crucial. Also, if this is on-street bay parking, we need to see the bays and the signs. In fact, it would be better if you could re-post this on pepipoo, where the very knowledgeable members will be able to assist.
  • Bay parking on street, good, they often make big errors on lines and bays so take pics lengthways showing the ends. Also showing the bays themselves. Copy/scan/photo the ticket (both sides) and remove personal bits. Host on tinypic and copy/paste the url on here. Repeat all this on pepipoo.com, and they will also help you fight the Ba****ds. Don't stress, peeps will help.

    Just goes to prove they DO have targets to meet and that Parking Pataweyo (Harry and Paul) is an accurate representation of Council Wardens.
