RTA and insurance help required please
Hi
not sure what happens now, RTA 8/10, non fault, I was stationary and someone rear ended my car.
anyway, car taken away, put into hire vehicle.
26/10 car returned to me and hire vehicle returned.
28/10 put roof down on car (h/top convertable), roof back up boot all misaligned.
on opening boot, have to physically push the boot up to get it open.
reported to garage that repaired car, advised to bring car back in which I did so on 1/11/10
they said they would sort whilst I waited, but I advised I had to go to work, so they ended up giving me a courtesy car, which had to go on their insurance, because my current insurance had now ended and I had gone with new insurance company and my old insurance company Aviva would not cover courtesey car and I didn't have my new insurance details with me because I never thought they would be asked to cover for an ongoing claim with previous insurance.
anyway car returned today, whilst better boot still misaligned and still hard to open, and now a chip on the rear of the car near to boot but on bit that runs up along the rear window.
anyway Aviva now sending out an insurance engineer from themselves at the request of the repair garage.
my questions are:
1) should I not insist my car is returned to the state it was as in non heavy boot (engineer at garage said it could be due to hinges/loss of gas???), non misaligned boot and chip rectified that has happened since the accident - whilst in their care.
2) what if they cant return it to the state it was in, but they feel the car can still be sold
reason I ask question 2 is because I bought GAP insurance when I purchased the car, and this will only payout if the car is written off
I don't see why I have to accept a substandard vehicle that is not of the same condition it was prior to accident on the 8/10
or have the car bought off me by the insurance and sold on leaving me with only the book price for the car when I had the forsight to take out GAP insurance (does what it says on the tin, pays the difference between book price and purchase price of the vehicle within 3 years of purchase)
thanks for bearing with me and if anyone can offer any advice I would be most appreciative.
thanks again...

give the garage fair chance to look at it properly, they have given an engineer a call to look at it wait for the verdict, it could be that when the car was rear ended it leaked a bit of pressure from the hydrolic boot/roof dampers. new boot/roof dampers and adjustment of boot lid bolts and you may be fine but insist they look at it properly and correct it.0

They actually point to incompetance on the part of the repairer;)I like the thanks button, but ,please, an I agree button.
Will the grammar and spelling police respect I do make grammatical errors, and have carp spelling, no need to remind me.;)
Always expect the unexpected:eek:and then you won't be dissapointed0 -
update; engineer from insurance company is attending tomorrow and I have been invited to attend with him, which I will do so.
hopefully he will be able to resolve the issues relating to the boot, but if it is a simple adjustment I am at a loss as to see how almost a month after the accident they haven't sorted it.
guess tomorrow might make it all a little clearer.2007 £1749

I hear what you are saying, but if it was a simple as that then surely they would have sorted it by now.
tbh I hope they write it off as most convertables are never right again after being involved in an accident that involves the roof or the mechanics of the roof.
will know more tomorrow once the insurance engineer has been out to assess.2007 £1749
