1) Where did you put the claim in
2) Have you sent it back
3) Does it track as delivered back with original seller?I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards. You have bought the second phone but not paid as you are waiting for a question to be answered?
A good seller would have replied, but he doesn't have to. You have bought it, so must pay for it.

thanks, i do normally always ask before buying and in-fact did ask another question the night before it ended he replied to that question, but then i saw the postel price and it just said economy delivery so wanted to ask if they would send via special delivery (postal charge was £6.00). what if i pay and still don't hear?have now given up smoking since feb 13th 2014 loving the money I'm saving0 -
You are covered for not receiving an item. Have a look at his feedback to see if he sells well.
You must be able to borrow a phone while you wait? I've got about three hanging around.0 -

You must pay as you've won phone as as macfly says you are covered for nonr eceipt anyway so why hassle about postal method?
Just pay and then if that phone doesn't arrive start an INR claim.
" las points though, the first phone, has it tracked back to show as delivered yet and if so have you told paypal so they can issue the refund?
Lastly, it sounds like you might be quite new to buying and without appearing rude it might be better to do a little more research on your sellers before you commit to buy.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards.
