Completed on House, got keys....then trouble.....

Friend of Mine has completed on their new house and collected the keys today, 250k and was in excellent condition when viewed.

However when they got to the house today, a number of windows smashed, kitchen tiling smashed, carpets ripped up, floorboards removed in some rooms, number of wall sockets removed and general damage all over the house.

Movers turning up tomorrow who can't be cancelled without losing deposit and needless to say the house is in no fit state to live in just yet and they aren't willing to take their young kids their yet.

They have been living with family over last couple of months since selling their last home and waiting for this to complete.

Wondering, if anyone knows where do they stand legally? is there anything they can do, or is it just a case that they are stuffed?

    I wonder if someone has broken in and nicked the bits...

    Your friend should have been told by their solicitor to get buildings insurance in place as soon as contracts were exchanged. If they have, the easiest way is to claim on it.

    They should take photographs and forward to their solicitor for advice...

    They need to contact solicitor who needs to query the other side for an explanation.

    There may be grounds to recover the costs to make good but the sol advice will be needed. Take lots of photo's.

    Even if the costs are only the excess on your buildings insurance it will impact on your premium next year.

    The property should be in the same condition at Completion as it was at Exchange of Contracts. When did they last view?
    So options are to claim on insurance or claim against the vendors for breach of contract.
  • I assume that you started your property insurance on the day you exchanged contracts.

    only sue, but were is the proof - get neighbours to look but who can say it wasn't like that on viewing...agents are conflicted out so hard legal battle.

    walking though before handing over money is not the UK system...maybe it should be, as some sellers are really mean....but did you do something to annoy them....like a last minute price reduction etc

    Was it lived in when he viewed it?
    By owners or tenants?
    Was it a normal sale, or a repossession?
