I really should update my story to include the news on DRO’s which came out last month:
I must thank SSAngel for letting me know on 14th November about the change due to come into effect in April 2011 which will mean that Mr 3Dogs will also be able to apply for a DRO. Many representations had been made regarding the anomaly that meant that pension funds were being treated as an asset in terms of a DRO when it did not count in Bankruptcy. After much consultation, The Insolvency Service announced that such pension funds will no longer count as an asset for a DRO with effect from April 2011. When I originally checked out DRO’s, etc, we soon realised that Mr 3Dogs would not be eligible as he has a small pension fund from opting out of the Government Scheme for a while and also, a tiny pension fund, from the period he was self-employed
We are currently paying token £1 payments to Mr 3Dogs’ creditors but, with this change in the regulations, he will be able to apply for a DRO as well in April 2011. When I get back home, I will write to his creditors with a new offer (about £15 to £20 to each per month) promising a review in 6 months. This should see us through to his DRO being applied for and, hopefully, awarded

So let’s get down to the nitty-gritty shall we and actually detail those debts – eek do I have to – yes I do!:
Me:

Credit card company pulled their normal tricks – never replied to any of my letters on my account and asked for signature on Mr 3Dogs account, and so I just started to pay them the £1 a month, instead of the £10 a month payable on my previous agreements.
I had been paying £30 a month to DCA for my old current account overdraft balance, but they accepted my £1 token payments fine. I had not yet arranged anything concerning our joint account overdraft. My catalogue was a little more difficult but did eventual agree to a reduction from £30 to £1
The main problems I had were with the surrendered car loan and Mr 3Dogs menswear catalogue. With the car loan, I continued to pay just £1 a month to the DCA even though they kept telling me that this was not enough. In September I received a letter from the DCA saying that the debt had been transferred back to the original creditor, who wrote requesting full payment. It was the same with Mr 3Dogs catalogue – though they kept telling me that the payment they had received with less than the agreed repayment of £20 and I had to pay the difference as well as next payment by next month – oh, and just to add insult to injury, they kept adding £12 for every letter they sent me telling me this – as the two letters saying the payment was less than agreed and that I had to pay difference and be charged £12 came separately, I was charged £12 twice - £24 per month added on each month, which meant that this debt just went up and up and up. And to this date they keep ringing up several times most days, but we recognise the numbers they call for as it comes up on the phone display, and now we just don’t answer them.
And so the six months went by, with me continuing my £1 payments without fail and paying extra to the previous year’s council tax and our rent arrears. The old council tax arrears were cleared in July 2010, but the rent arrears took longer to clear than I had planned, with other things cropping up, though that will be up to date as of 27th November 2010 – yippee!!
Anyway, with our rent arrears nearing clearance, I did the CCCS Debt Remedy online again using figure which assumed this fact, and it came up recommending a DRO (Debt Relief Order) for me, i.e. I had less than £50 left after normal household expenses, no assets over £1000, and a car (van) worth less than £1000, so I clicked the button and they sent me out a pack with the application forms and all the relevant information. They enclosed a form to request a free up-to-date Credit Report from Credit Expert and I sent off that form straight away, receiving the report within a few days. Nothing different was showing on the report, so that was OK. I also had to contact all my creditors for up-to-date statements or letters confirming the current amount outstanding on each account. These eventually came back in, though when I telephoned the creditor about the £1,300 owing on our TV hire purchase account they confirmed that the debt had actually been written off and they sent me a letter confirming this. Doing all this really made me feel more positive about my situation again – that that light was getting brighter at the end of that long tunnel
So, with all the documents I needed together, I posted them off to CCCS with the DRO application forms, by recorded delivery on 12th October. I received a letter back requesting statements/letters confirming balances from all Mr 3Dogs creditors too, and posted them to CCCS again by recorded delivery on 26th October, but they were returned to me a week later stating that they had requested them in error, thinking that Mr 3Dogs was applying for a DRO at the same time. I had explained in my application on 12th October that he was not eligible due to having a pension fund, but they had missed this point when checking through originally
I would add here, for future reference, that my Mam, who lives up in North Tyneside as does all of our family, was taken into hospital on Tuesday 16th October 2010 and, after seeing how things were going, I went up their by train on Saturday 23rd October. I posted Mr 3Dogs’ requested paperwork to CCCS from up here and Mr 3Dogs, who stayed at home looking after the doggies, told me that they were returned, reading out the letter to me on the telephone. As I was up North and I expected a telephone call from CCCS anytime to go over the details of my application, I telephoned them mid November to explain my situation, to be told that I would get a letter within the next 2 weeks with a draft application to check and sign, together with paying-in slips to enable me to pay the £90 fee. Mr 3Dogs told me on 26th November that the letter had arrived and he posted it up to me to deal with. I would add that, at the beginning of November 2010, that Mr 3Dogs told me that I had received a Tax Demand from the Inland Revenue regarding PAYE underpaid for 2 previous years, and Mr 3Dogs sent that up here to me too though I did confirm with CCCS when I rang them that this could be included in my DRO application
So that brings us totally up to date – literally, as I received the paperwork in the post today from Mr 3Dogs and I will be able to continue giving you details in my normal posts. I will continue to post all details regarding our debts in red, so that it is immediately noticeable when lurking or catching up on my diary ..................................

Amy's school is still open (rant rave, bloody hill) but the ones nearest to us are still closed so makes me feel better. No snow forecast overnight for
us but very cold. Still, if the buses are on I'm off to take Amy to school. My mam's school (works in edu too) has been closed all week
due to the drive covered making it inaccesible for cars, deliveries etc so we'e hoping she's off tomorrow too (looks like it as the plough is booked for Sat
to come clear it) so she can come over, play with Lucy and company for me. We might trek the fields tomorrow if mams there because Lucys Salopettes
arrived this morning.
i tell you though, all this snow and how troublesome it's ben hasn't dampened my spirits for Skiing Hol is Salzburg. I will get there one day!!!0 -
