Range Rover - Fault & Warranty Issues
Hi there.
Can anyone help. Its complex!
We bought a 2nd hand Range Rover from a private dealer in Salisbury back in February this year. The vehicle has since needed a new engine due to internal overheating from what appears to be gasket failure. It had only done 69000 miles and we had only had it 5 months and added 2000 miles & its in top condition.
We paid for an independant inspection which concluded gasket failure causing a hose to possibly fail.
We took a warranty out from the dealer with a company called APA and they sited a faulty water hose as the cause of the problem and they do not cover hoses they stated that it was not gasket failure and that our report agrees with their`s (we have never seen their report!!). Our report does not conclude a hose problem as the cause.
Our solicitor advised us to accordingly as we had contact the dealer straight away as there was an intermittent engine management light problem ( this came on coming home as did the air suspension inactive) He was informed when we arrived home as we live some 70miles away. He told us that the computer codes needed to be reset and this was done and the engine management light did get re-set the air suspension, however, needed a replacement cylinder, this was covered by the warranty...hurray!!
The vehicle then was used intermittantly as its not the main mode of transport for us in the summer months and so time passed. However, when we used it again after a standard service the engine management light came back on. Our local garage had it back at once and carried out investigative work (also not covered) and found the engine had been letting water into the cylinders and this had, therefore, caused localised overheating and severe damage, hence a reconditioned engine.
At the time of purchasing the warrranty we were advised that the vehicle could be taken to any garage and for our convienience we took it to our local Land Rover dealer and they were given the go ahead before any problems could be rectified.
Since another garage has been helping us sort this problem out the original dealer is now pointing the finger of blame in their direction and is not prepared to take responsibility. Furthermore as we had purchased a so called copmrehensive warranty we felt that we would be more than covered for any major problems but they have failed to help us also and so we have paid for the car to be fixed from our own pockets.
Who is at fault here and would the FSA be able to assist with the warranty side of things. We are still contemplating court action through small claims to at least get something back.
Sorry its so long winded but thats as short as i can get it!
Thanks

What sort of RR is it?
I'm guessing its a 4.0 or (more likely) a 4.6 V8 P38A.0 -
Yes a V8. The original dealer is trying to suggest our type of driving amoungst other issues like not letting him know (we did) on returning home caused the engine to fail along with our local Land Rover Dealer not fixing the problem properly in the first place.
We have just received all the blurb back from the solicitors so i think that it is worth pursuing the warranty company as their own inspection, having just read it, is not really conclusive either.
The vehicle is fixed and usable at least but thats not really the point!0
