Hi
I am in a DMP with CCCS and Halifax hav enow passed their debt onto the above DCA.
They wrote to me a couple of weeks back asking me to pay the full amount. I called CCCS who advised me that they had already been in touch with them to change the payment details to themselves so I should do nothing as they had dealt with it.
I then got another letter last week threatening that because I had not been in contact they would take it to the next step. I wrote back to them on 24th explaining my situation and saying I was with CCCS and they should have by now already had their first payment.
I then recieved a letter yesterday (dated 25th October) saying 'Notice of intended court action'. It says papers wre now being prepared for court action and that they could place a charging order on my home etc.
I don't know what to do now, has anyone else had this with this company. The deabt is only for £314.50, is it too late to try and raise the money just to pay it of and if I do that will the other creditors think i'm favouring them etc?
I really don't want to go to court!
Thanks

Its extremely unlikely that you'll be going to court. Blair Oliver Scott ARE Halifax. Same company. BOS are the in house collections team for Halifax/Bank of Scotland. If they took you for a CCJ, which is unlikely, the judge would tell them they had to accept the monthly payments from CCCS as this is all you can afford. A charging order is only granted where a person has not complied with the judgement in a CCJ. You are already making payments so it won't happen. Certainly not for £314. Please try to stop worrying about this, you've done the right thing by sorting your debts with CCCS. BOS are just trying to bully and frighten you and so far its working, don't let them win!!0

Just ignore the letters and forward a copy of all letters you receive to CCCS....they will deal with them directly0

Hi and as above advice really.
I am in my own self managed DMP and my halifax account as been passed over to BOS.
They have accepted my paymemts and all ok - although she did ask me for some info and I said but surely if you are the inhouse DCA for Halifax you can just walk along the corridor and get it... apparently it doesn't work that way.
she also asked if she could keep my debit card info on file to make payment easier for me.... erm let me think
that would be a no!

Hi thanks for the advice. I actually just bit the bullet and called them this morning.
Actually the lady I got was really nice and said 'we all have circumstances beyond our control'. They had already had a first payment from CCCS and she just said that she had written it on my file that I will be paying an amount through CCCS each month and all would be fine. She even told me that if I came into some funds I could offer a partial settlement!
I feel a lot better now, glad I called, sometimes its the best way.

If you do go for a settlement, make sure you deal with it all in writing and that your credit file is marked as satisfied and that neither they, nor a 3rd party or any associate will chase you for the remainder and that you are released from further liability. National Debtline website has a good template letter you can use for this. Post back on here if you get to that point and the good peeps on here will advise further on how to deal with it.
This is important otherwise they will sell the remainder on and you are likely to be chased for it in the future. I've had my fingers burnt on this one.Debt 30k in 2008.:o Cleared all my debt in 2013 and loving being debt free
