Used Car Contract - Help!

Good evening guys,

Im in a bit of a pickle about a car we went to buy last week and need some advice.

We made a deal with the garage that the PX value on our car was £1500. This was around what we were quoted in a few other places, the car is a C cat (been in an accident in its past) . They called a few days later and said they had got it wrong and now as they have done the HPI the PX is only £750. All the docs etc say £1500. I said we cant afford this and to knock the deal on the head. That was that, not a peep out of them from last Weds.

Today, a call goes, we have your new car ready! After hours of arguing with them saying we told them we couldnt afford the deal at £750 PX, they are now playing nasty saying there is no cancellation and we cant back out.

We are going to see them in the morning. Any help and advice would be brill.

    Did you make them aware it was CAT C ? if so I can't see how they can change the deal - it would be binding.
  • Well this is where I think we mucked up. Every other garage we went too they HPI checked and knew, value still was £1500. We went to these and they offered same, so we assumed they had done the check so agreed.

    No where did they ever ask, we just assumed!

    Mmmm - what sort of garage is it - main dealer - large independent or small dealer. I'd expect the former two to do a check. your arguing point is that you were offered £1500 elsewhere. Out of interest how much is the car your buying?
  • Its a main peugeot dealer. New car is 13k !

    I would have thought that they would have checked - were the other PX quotes from similar main dealers? - if so use this to put your point across. Did you get a discount off the car you bought? it might give you more leverage if you didn't as they always allow a margin to overvalue trade-ins.

    Sorry - forgot to add - check what the contract says - does it mention that the value can change under such circumstances? did they check the V5 - I believe that lists the car as a CATC

    No, it won't be on the V5. At least, I've never seen a total loss marked on one.

    Is this incorrect or not always the case? I don't know because I've never been involved with such a car, but I'm going on what I've been told to look out for when buying a car - If it's not on the document, it could give the OP more of a case.

    Can you (and the OP) please let us know, as I've never had the opportunity to come across one, but a friend told me that it is listed on the V5 - if it isn't it shows the importance of doing proper checks, although they dont seem to be 100% safe either.
