Hi everyone i was wondering if you could help me?
I have recently been recfiving letters from the following
JB Debt Recovery
MCE Portfolio Limited
Philips Bailiff And Recovery Agents
Lowell Financial - Consumer Lowell PF1
The 1st thing i would like help with is how are these people getting my phone number? i am reciving a great number of calls and text messages which is now becoming a joke.
The 2nd thing is:
I have read all about the prove it letter and the Statute barred letter (i have done this as any debt i may or may not have had in the past will be no later than 2003) will these letters be enough to stop all this from these companies?
And lastly should i send the prove it letter 1st then put together the statute barrred letter after that or go straight in with the statute barred letter? or is there any other thing i should do?

1st - did you use your name as your user ID? If so please contact Abuse to have it changed! Your creditors often google your name and if this post comes up you're giving them a heads up on what you're doing...

2nd - When did you last make a payment or acknowledge the debt in writing? This is the date that matters... not when the debt was accrued - at least if you are going for statute barred.
If it's statute barred then I'd go down that route - 6 years in the UK - 5 in scotland.DFW Nerd #025DFW no more! Officially debt free 2017 - now joining the MFW's!

Hi Paul and welcome to the forum,
You should definately send the prove it letter first and wait to see what response you get, although do not sign the bottom of the letter with your normal signature (print your name), as some dcas have been known to copy signatures when required. I've attached the telephone harassment letter which you can also send (print your signature though!), which should ensure you only get communication by letter from them. They were able to get my details and I've no idea how either!

I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing. I have verbally requested that these stop, but I am still receiving calls and I now require all further correspondence from your company to be made in writing only. I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.
If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine. Be advised that any further telephone calls from your company may be recorded and used in evidence and I expect this harassment to cease immediately.

i didnt use my real name as my id!
The last time i would have made any payment but have never acknowledged anything in writing! anything to do with this would have been before July 2003! Long story but most of my debt and subsequent problems were in 2002 and i moved from the place i was living in 2003 and have never heard anything about that period in my life untill these letters started apearing!0 -

Hi Paul,
The letter should do the trick, but unfortunately some of them are so thick that they need 2nd or even 3rd copies sometimes:eek:. Send the letter recorded delivery and if they do continue to phone, don't go through the security check, tell them you only wish to be contacted in writing and hang up. Continue to do this and even they'll get the message, although they're persistent idiots.If you've nothing decent to say, perhaps you shouldn't say anything.

dont sign any letters you send.
personally as they are so old id ignore, u never know they may not even be your debt and they could just be fishing. and once u respond...BANG more calls and letters.
if u do phone them, withhold ur number but be prepared for abuse from them.0
