Recorded Phone Conversations

Quick question,

A delivery van at my home addressed was clamped today. I contacted the parking enforcement company (Whites) claiming that they had committed an illegal offence but didn't get anywhere. I instructed the delivery company to pay the charge and appeal/chase it up in court. There is a very good chance of success due to lack of signage etc.

Apparently at some point the clamp was removed but not by the parking enforcement officer. I genuinly know nothing about it, i'm sat at work, however I received a particularly disgruntled phonecall from Mr Jason White himself (who had previously pretended to be a call centre worker) who stated that my earlier call was evidence of criminal damage and that my conversation would be submitted to the police.

My question is this - are they allowed to use the phone call and pass it on to third parties? I was not informed during the call that I was being recorded and there is nothing on their website that I can find that says you will be recorded if you contact them.

Help greatly appreciated.

    Without warning you first, the recording itself cannot be used as evidence. However there is nothing to stop them submitting a transcript of the conversation. If it ever got to court and you contested the transcript, the judge could allow the recording itself to be submitted as evidence

    You would have to have actually said "if you don't remove it I'll do it myself" before anyone could think about taking it seriously though...

  • The first phonecall was nothing about removal of the clamp. It was me asking if they thought it was right that they clamp delivery vehicles, to which they answered yes. I then asked exactly how residents at my block were supposed to have daytime deliveries, he didn't care. He claimed to be a call centre worker and told me he couldn't do anything about it. I then questioned him and found out that he was the director, as such it was more of a case of wouldn't do anything about it.

    I heard about the clamped being removed later on when Mr White called me at work and was quite irate about it. He claimed that i'd done it or some nonsence and that the phonecall was evidence. I quite rightly stated that I was at work and i don't see what the previous conversation had to do with it but just babbled on about criminal damage and hung up.

    I suppose they'll submit the transcript then. Most incriminating thing on there is him pretending to be someone else.

  • Tell the **** to put up or shut up. He is irate as he has lost money. He is simply trying to initimidate you. You did not do it and he has no evidence that you did.

    I would guess, from what you say, the driver probably removed it and good on him if he did.

    Good on the delivery driver I say ;) anyway if you can prove your whereabouts he hasn't got a chance, if you speak to him again, ask him if he is looking for job now that his scam is ending lol

    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    Well said, good on whoever got the stupid clamp off. Nowt the scammer can do about it.

    I do know that Whites have upset just about every resident/visitor/contractor that has come near my block of flats this year. They unmercifully clamp anything on wheels and have particularly ambiguous 'rules' which they've exploited to catch out many people. Wouldn't surprise me if everyone in the whole block has googled 'how to remove a clamp' haha

    By the looks of the photo Mr White took a real pasting. After a couple of calls with him I really can't think why anyone would want to do that :rotfl:

    Sometimes these padlocks are faulty and spring open. It's just one of those things.

    Bit like when that clamper fell down the stairs. It's just poetic justice. ;)
