From the wording on the letter from Marston Group this almost certainly a CCJ hat has been "transferred up" to the High Court for Enforcement and a writ of Fi Fa has been issued against you.
You need to advise Marston Group immediately that you know nothing about this debt and that you are applying to the County Court to have the Judgment set aside. You need to make it clear that the property that you lie in is owned by your parents and that with the exception of limited personal items, all goods are owned by your parents and that for this reason, any bailiff from their company will NOT be given "peaceful entry" into your home.
You need to immediately contact the relevant County Court (this information should be available from Marston Group) and apply to set aside the Judgment by completing an N244. On this is is important that you state that you wish to SET ASIDE THE JUDGMENT .......and to STAY THE EXECUTION.
PS: If you have a car, you ned to ensure that it is not outside of your home as this will almost certainly be removed.0 -
Just got another letter from them today basically asking if I'm using my opportunity to pay or threatening to force me for wage certificate and mentioned something about the equity of this property. Neither of which are relevant to me since it's not my home and I'm unemployed right now.
@Herbie21 That's quite thorough and useful thank you very much, I'll be sure to do the N244 (have already got the form online) once I've heard from them about to who and what the debt is for.0 -
