I wouldnt hold your breath though,
put it this way, if someone owed you money and you were having trouble getting it paid back to you. They then paid you, yippee,
then they said they made a mistake, 'can i have it back' I know what your answer would be.

The difference is i didn't pay them... they TOOK it without my say so, and i didn't make a mistake (apart from using them) because i didn't do anything !

To the above poster ... no i did not read the T & Cs properly, i am sure not many people do, for many reasons.

What this means is that any loan , overdraft, associated credit card or any related debt of any sort can be pulled in at any time without notice of any sort no matter the consequences to personal life and family. They certainly don't highlight this to customers ! ... so they bury it in T & Cs ... BECAUSE most people don't read them ! and alot wouldn't understand the full meaning.

I think people need to be made more aware of this possibility and also the banks that will actually carry it through, they don't highlight this because people would go elsewhere if they knew.

It has been widely publicised in the news recently, namely the BBC and other news providers. Even MSE Martin has an article here. Unfortunately it is a common practice with all banks not just Barclays.
    Best Regards

you didn't pay them so they took the money, as is clearly stated in their terms and conditions. Not just them, but every other bank.

Martin actually says don't have your savings with the same company as your debts, for this exact reason - he also means current accounts.

Unfortunately you've learned the hard way.

Although I do sympathise with the situation you now find yourself in, you can't get away with that claim. You gave your say-so by agreeing to the T&Cs (regardless of whether you actually bothered to read them).

Many people do read them though, as you can now begin to appreciate why.

Overdrafts can always potentially be called in, but in practice if you abide by the conditions of the account there would be no reason for them to do so. As to loans, CCs etc, as long as you keep to your side of the agreement by not defaulting or otherwise not paying, then no they can't/won't be called in.
  • Thanks for the links

Wow certainly been an eye opener... trouble is not many people know, at least nobody i have spoken too

In fairness, it has been publicised quite a lot lately, stories in the paper, martins colums and on morning TV.

Jimjames, presumably the took the whole debt because they left £20 in the account as the oP said in his post.

If there was going to be a debit balance they would have taken the whole lot.
make the most of it, we are only here for the weekend.
and we will never, ever return.

I doubt you'll see that again, sorry but true.
