Dropshiping Problem

Hi
What are my rights if a company offers next day delivery on an item via ebay, but then dropships that item from Germany?
Ebay rules are that sellers arent responsible for delivery times but item was never going to arrive next day and took over a week to turn up.
Item was for a printer ink and so ended up just going to local store and buying from there instead. Cost of sending it back to Germany for a refund would almost cover whole item cost so any refund would be minute.
Any one else had problems on ebay where people dont actually have the item in stock and just order from another site?

Does the seller warn the item is drop shipped? Also did listing state next day delivery or next day despatch, there is a difference.
If not and you were expecting an item from the UK I would be seriously unimpressed and would contact the seller to ask for a UK address to return it (as a business seller this should show in the listing anyway). Printer ink is always useful - keep the extra cartridges so you don't have wait next time the cartridge runs out. (Although I could be misreading the situation, that has happened to me and I've just stashed the ink somewhere safe).

You cannot misrepresent the location of an item on ebay:

However I am confused by the fact that ebay does not pass on this fact to buyer protection and instead switches to using the term seller location (not item location).

Buyers won't be required to return an item where the seller’s geographic location is different from that shown on the listing (in violation of eBay policies), unless the seller pays for return postage.
I cannot locate the ebay policy that requires the sellers location in the listing - see above policy on item location.
With drop shipping item and seller locations are different so ebay rules confuses me by switching between use of these terms.0
