Parking fine for overstaying in private car park - advice sought

Hi

On Friday 22 October, my car was parked in the car park of a store (part of a national chain) after 5pm. It was not collected until after 11pm.

This hadn't been a problem in the past but, admittedly, the last time the driver parked there after 5pm was last year, perhaps longer ago than that.

I've received a letter on Friday (29th) entitled "Parking Charge Notice" and stating that I owe £95.00 for "Exceeding the maximum duration if stay permitted at [store name] [address]". If payment is made within 14 days of the enforcement notice issue date (27th October), then the fine will be reduced to £75.00.

The letter states that the company concerned obtained my details from the DVLA. I find it interesting that the company has automatically assumed that the reigstered keeper is the driver. Certainly, it is not possible to tell from the photos included in the letter whom the driver is.

I have read the advice provided on MSE and the general guidelines thread in this Forum but would be grateful for the benefit of others' expertise and knowledge.

Although the advice says that the best approach is not to pay and that most companies will give up after a few letters, should a payment be made because this company has gone straight to the DVLA to get the registration details of my car? Does that make it (more) legitimate?

£95, or even £75, seems excessive. Does anyone know what the equivalent would be if parked in a public car park?

I am going to check the car park today to see if there are any notices and what exactly they say, so that all concerned have as much information as possible. Is there anything else that should be done?

    That doesn't make yours unique, all PPC's go to the DVLA, that's how they get your address to send their threatograms to.

    They will not take you to court, i mean how can they when they don't know who was driving, you as the registered keeper are not legally obliged to tell them who is, despite what they say !
    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    Why waste your petrol, if you have read all the advice on here why not take notice of it and ignore and do not spend money on stamps replying to them either.
