employment and support benefit

My wife`s work terminated her contract due to ill health and we are now in the middle of a dla claim. She has also applied for employment and support benefit but it has been refused because she missed a couple of national insurance credits and now she thinks thats it now we cant do nothing about it.

So my question is, can we do anthing about it? Coz if we cant we are screwed with just my wages coming in.

    If you work full time she will not qualify for IB ESA, however if she does not have children she should still claim in order to maintain her NI record.

    Unless there has been a mistake on her National Insurance record there is nothing you can do about it.

    If she was self employed she could pay the missing class 2 NI conts.

    JCP will have used the tax years 07/08 & 08/09 to decide the ESA claim.
    What was your wife doing in these tax years?
    Does she have the P60's for these tax years?
    The P60's would need to show earnings of at least £4350 for 07/08, and £4500 for 08/09 to qualify for ESA.

    If she worked in both tax years, and earned over the figures, send copies of the P60's to JCP for them to investigate.
