Refused DLA 2nd Time

Because the refusal came only two weeks after you applied for DLA, it is obvious that they havent looked at the case properly, unfortunetely this is happening all the time now, I think that the DLA is refusing people hoping that they wont go to appeal, appealing DLA is easier than the ESA, I would let them know that YOU ARE GOING TO APPEAL OVER THERE DECISION, and ask them to look at your case again.

This can take up to 3 months to do, and getting an appeal date may take up to a year, but it will be backdated until the first date that you applied.

I wouldn't of thought that the evidence from your Esa appeal would carry much weight tbh as I was refused DLA initially despite being on IB as all that proves is that you are not fit for work not that you have care/mobility needs.

Do you have a pychiatrist that can provide evidence to back up your claim as that is what I used.

also if you are unhappy with atos (as are many many people) phone the dwp and begin the official complaints procedure against them, make sure you tell the mp's office this when you phone to make the appointment, and good luck

Thankyou for your advice shall definately approach my local Mp on monday but it is hard to even get an appointment with them if you have to speak to a rude receptionist like I have had to in the past

Yes the form was completed by a welfare officer fully and accuratley and he has full background information on my health issues
