stupid mistake

i recently visited a retail park and pulled up right outside the door of the store i wanted to visit (no other cars around and loads of spaces). i had had a really bad day and was in a world of my own.
when i came out there was a ticket on my car - i had not seen the sign right infront of my car or realised i was in a disabled space. i am not an inconsiderate person, and NEVER do this - genuine one off stupid mistake.
i have read so much about tickets on private land and not to pay, my head is spinning and i don't really know what to do.
the fine is for £80 reduced to £50 within 2 weeks both of which are extortionate.
if it had been £30 i probably would have paid and let them win for me being such an idiot in the first place, but not the amount they are asking.
the company is parking eye
any constructive advice would be welcome, thanks :(

  • Just ignore it. It's an unenforceable invoice. [STRIKE] If [/STRIKE] When you receive other threatening letters, ignore them too.

    Make absolutely no correspondence with the company, not even a letter to tell them that you're ignoring them, and that their practices don't have a legal stance.

    File everything you get with them away, in case of any (EXTREMELY unlikely) court proceedings, but just forget about it.

    Yeah must be difficult to see those huge symbols on the ground in front of you, especially since every retail park in the UK that i have been to reserves those near to the store for disbled people and sometimes a few for those with children.

    The only thing that has been changed is the law regarding clamping.

    However you have parked against the rules laid down by the owner of the land, not sure of the legalities but as said recent changes seem to revolve around companies clamping cars, not issuing a PCN.

    You would need to check the sign as the owner of private land only has to allow you access under conditions that they down.


    It is one thing to argue in court about parking where you couldn't see a badly placed sign, but you parked in a clearly marked disabled bay situated in a position that is so common that no court would accept that you didn't see or know about it.

    Saying you have had a bad day doesn't explain why you couldn't see what was infront of you, rather you have got a ticket that you didn't expect and you are looking for loopholes to get away from paying the ticket.

    You may think I am being harsh, which is because i am, there is nothing that winds me up more than somebody so wrapped up in their own little world that they act with no regard for anybody else around them.

    This ranks up there with driving through a red light because you had a bad day or running into the car in front because you had a bad day.

    The above poster advocates ignoring the "unenforcable invoice", that maybe so, but I know of lots of minicab drivers that got an "unenforcable invoice" from McDonalds for breaching the displayed rules for using the car park down at Heathrow, they all lost a County Court.


    Don't confuse issues, this is aa different situation to cowboy clampers blocking people in and clamping them in small car parks based on vacant lots in small towns.

    Any links/proof of these minicab drivers losses? I wont hold my breath.

    Please do not class the guy issuing the private parking charge as a ticketer, he is merely a 'invoice guy' he in no way issues 'tickets' as those would carry enforcement, to which, private parking charges, do not!

    there is a problem tho with the op's story:

    no matter how bad your day is, the parking is always the same in retail parks, so doing it wrong here is akin to perhaps crapping in your bed because you 'forgot' humans use toilets, or walking out of a shop without paying because you 'forgot to pay'.
    inexcusable, but also slightly humerous! :)

    Yeah right, more like you saw the feature on Watchdog and like to think they all got charged and locked up for the 'offence'. Just as likely as your next statement...

    Quite big things to loose, those County Court buildings!

    I have honestly never heard of ANY private parking company winning at court.

    BTW, it's more likely to be Parking Eye or someone like that issuing the 'fine', not McDonalds themselves.
