Clamping at Changegate Private Car Park, Howarth

We were clamped at the infamous private Chnagegate car park at Howarth for not dispalyng a valid ticket; it had still forty minutes to run when we returned to the car, but had fallen off the windscreen on a hot day.

The employee doing the clamping was shown the ticket but refused to let us off, insisting we paid the £70 and appealed. However, when we gave him the money and got a receipt, on the back of the receipt it said one of the invalid reasons, according to them, was not displaying a valid ticket and no money would be returned for this reason.

We then wrote to the owner, Mr Evans, at the P.O. address and the car park address and both letters were returned to us by recorded delivery. These were the only two adresses we had for him. We still have the ticket and all the letters.

Shoud we take Mr Evans to the samll claims court? If so, on what grounds?

    Hi 196. How did you pay the charge? Was it £70 for a clamp release fee? Did you get a receipt? Is there an SIA number AND a signature on the receipt?

    Any court action should name both the landowners & the clampers, as you have discovered clampers can be hard to pin down.

    Edit to be clearer: Before filing at court you want to send a LBA to the landowners/clampers, in many cases the landowner will pressure the clamper to repay at this point.
  • If this is the one I remember the clamper and landowner are the same. (I might be wrong here)

  • First check who the landowner is and where he lives. (I suggest you also post this on pepipoo.com)

    I think someone should hand out leaflets there in the inevitable full throttle shake the cars till the ticket falls off and clamp em run up to the ban.

    Oh and I think someone should clamp the Rolls Royce in the video (or whatever car he has now).

    Adam, this user hasn't been here since almost 2 years ago, the thread is a very old one.
    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?
