quick question re protection from harassment act 1997

just rec'd my second demand (£90) from the lovely euro car parks and I'm now sitting back and waiting for the usual and pointless threats.

just thinking though: if (and it's a big 'if') these monkeys switch tactics and start phoning me at home.............well...how would they obtain my no. if I'm ex-directory, telephone pref.service, etc?
does the dvla provide details? can my no. be traced by other means?

just a thought.

    They will try to track your number down using public and lawful means, but cannot get it from BT if your ex-directory, nor can they access private files. It's unlikely the DVLA will have your phone number unless you told it to them. I can't imagine why anyone would do that.

    If you've given your phone number to a company where you didn't tick the box to opt out of being contacted with "products and services", then it will be sold on to other firms to sell you crap.. and may end up on the PPCs "sucker" lists.

    To prosecute for harassment, you would have to show that the phone calls were causing you alarm, distress or humiliation by virtue of their frequency, manner, occasion or of any threat or publicity by which the demand for payment is accompanied.

    Under the Protection from Harassment Act (section 2), it is an offence for a person to pursue a course of conduct which amounts to harassment of another, and which he knows or ought to know amounts to harassment of the other.*

    *For this purpose, the person whose course of conduct is in question ought to know that it amounts to harassment of another if a course of conduct amounted to harassment of the other. Conduct includes "speech". A "course of conduct" must involve conduct on at least two occasions. [King v DPP, 2000]
  • If you provided your phone number to dvla then they will sell that also. They don't care, its money after all.

    Im sure I read a thread on pepipoo recently where someone had taken one of the ppc scum to court for harassment and won compo of a grand, cant find the link now :mad:
