Leaking roof - insurance refusing to pay out

    You would have had some cover if you'd paid by credit card, so that's worth considering if you have any work done in future.
    It's sometimes worth even paying credit card fees to have the protection.

    I sympathise as there is no way you could have known the work wasn't up to scratch or that he would be uncontactable either.

    The credit card company are jointly liable under the consumer credit act. I am assuming the amount paid was over £100 (which I think is a fairly safe bet).

    So if there is proof that this was bad workmanship (and not wear & tear as suggested by someone else) then the card company would be jointly liable. If it's wear & tear then I agree it's not covered.

    Do you think it's not covered?
    If so, why not?

    Obviously we don't have the report so assuming that points to the original work being faulty.

    None I think. As the section 75 claims under a CC would be affected by the relevant limitations act. In England and Wales, any claim would have to be submitted within 6 years.

    Same thing, used Homeserve as part of Esure.
    I was never told the 'repair' done by Homeserve was temporary. Long story short, every person who's come to see the roof, admits verbally its the neighbours roof which is terrible condition that's causing a leak into the house :(
    However, as they want there £500 from Homeserve they will not admit it on their reports. A surveyor was sent to the house (same guy at the neighbours as it turns up - conflict of interest methinks!)
    The FOS is now involved as Esure is blatantly telling lies, apparently they have been the ones trying to help, but i have been refusing that help - what a joke. If i could fix the problem from myside i would, but this is water coming in from the party wall-down the beam-into the room, already there is a hole in the wall where the plaster has eroded away :(.
    I have tried to repeatedly speak to the neighbour, but to no avail.
    Can anyone pls give me some guidance as i am at my wits end :(

    Be VERY CAREFUL, with links to external sites offering help. The link site is only offering a mobile phone number and email address.

    How do you know they won't charge you fees, which you have no way of getting back.

    Suggest that you speak to an established local roofing contractor and ask for a condition report.

    Judging by the number of times he has spammed us with this website recently (and broken site rules by requesting pms from distressed posters) he has more than a philanthropic motive in urging us to contact this "engineer" with the dodgy looking website!

    (Note he even has "dug out" four year old threads to stick in a cynical post and include a request for a pm so he can help out!)

    And you wonder why he recommends a "third party" to us when he has told us already he is a structural engineer who can deal with an "insurance surveyor's nonsensical points" himself:
    I am a Structural Engineer. Hence I am qualified to state that the points highlighted by the Cunningham Lindsey employee are nonsense.........
