my husband is in receipt of incapacity benefit, we have just sold our house and will be moving to rented accomodation leaving about £90,000 to be saved/invested/living from, would he lose his ib if the cash was in my name?

Incapacity Benefit is not means tested, so he would not lose it if you sold the house. If you claim any means tested benefits, these would be stopped.Gone ... or have I?0

It would be fine for it to be in his name. However, it is not yet clear how those on IB will be affected when they transfer to ESA. Though they will initially go onto CB ESA (non means tested), they *may* be transferred to income based ESA in the future. If this does happen, your joint income will be assessed, so it really won't matter who 'owns' the capital, you will both be treated as having it.Gone ... or have I?0 -

Seriously, if you have 90K to play with, do you even need the pittance that is IB?[greenhighlight]but it matters when the most senior politician in the land is happy to use language and examples that are simply not true.
