incapacity benefit

my husband is in receipt of incapacity benefit, we have just sold our house and will be moving to rented accomodation leaving about £90,000 to be saved/invested/living from, would he lose his ib if the cash was in my name?

    Incapacity Benefit is not means tested, so he would not lose it if you sold the house. If you claim any means tested benefits, these would be stopped.

    It would be fine for it to be in his name. However, it is not yet clear how those on IB will be affected when they transfer to ESA. Though they will initially go onto CB ESA (non means tested), they *may* be transferred to income based ESA in the future. If this does happen, your joint income will be assessed, so it really won't matter who 'owns' the capital, you will both be treated as having it.

    If you claim help with your rent or council tax it won't matter whose name the capital's in; your benefits will stop regardless.

    the money you have from a sale of property it will be factored in when you go for housing benefit doesnt matter who's name its in as your both a couple youll both be treated as having 90k.
