They would review an indefinate claim after a max of 5 years, indefinate to the DWP just means 'no set time for review'. So they always review them within legislation times (if not before if they can find an excuse to do so)

When you said indefinite I thought you meant exempt from the PCA - some of these people never have medical assessments.

I have been on IB since 1996 and never had any kind of assessment except for DLA Medical.

The OP's friend needs to 'man-up' and learn how to 'work the system' like the others 'on their road'

I will be passported staight on to ESA (support )As I receive highest rate DLA and Mobility

You will be assessed as everybody else. You will not be passported straight into any group unless you qualify.
Just in case you were wondering (some have)..... I'm a woman!

Well you're fortunate to not have been dragged through this process twice in a matter of months aren't you! He does not need to 'man up' thank you very much or con the system, total unnecessary comment

No, I was just referring to when the tribunal recommend the DWP leave you alone indefinately. Which they did for me in the past, but they still call you in...

Stardusty, I don't know what your exact involvement in this situation is but you do seem to be emotionally involved from the tone of your posts. I don't mean you are being offensive but are commenting from the heart. I think you have simply realised what a real problem the benefits system and it's future reform is to genuine claimants, unfortunately they will be tarred with the same brush and have to prove their right. Guilty untill proven innocent from now on. ;)
I like the thanks button, but ,please, an I agree button.

Will the grammar and spelling police respect I do make grammatical errors, and have carp spelling, no need to remind me.;)

Always expect the unexpected:eek:and then you won't be dissapointed

Im very tired at the mo, so cant think straight, but are you *sure* about that?
    Exemptions
Certain people are treated a having limited capability for work, meaning that they do not have to satisfy the test.
The list of such claimants is different from the one that applies to the personal capability assessment for incapacity benefits and does not include, for example, people who have severe mental illness or who are entitled to the high rate of the care component of Disability Living Allowance. Nor are people, entitled to the ‘support component’, automatically regarded as having limited capability for work.

as I say, im tired so may have forgotten something, but If your not sure, check.....

I am a relative and of course I am 'emotionally involved', who wants to see their family member go through this again? This has been going on for a year and half now, from initial assessment, tribunal and now this. I haven't been offensive to anyone. I disliked the comment by someone suggesting my relative should 'man up and con the system'! I've not come on here to read stuff like that, only for genuine help from people who have some knowledge on the subject, that's all. It's very stressful for all involved and I hate to think it's happening to many other genuine claimants, it's unfair.

Why are you on this forum ? If it is not to vilify claimants in your 'relatives' road who may or may not be receiving benefits

    What exactly was your question?

Answer on a postcard please pmsl

You just want to rant and vent about the 'system'

I in no way suggested they should con anybody

    Coolie
