all detail i have mentioned. i genuinely meant what i said when i say i know numerous people who have used a company car for an extended period, following redundancy.
i may be guilty of one thing in all of this i guess. trying to ensure i was in control of monies, if administrators arrived at my door. certainly didnt want to be left holding the financial baby!!!

Well looks like you will have to speak to another solicitor and find out where you stand with the car and the money. As its certainly not yours as the car wasnt yours so you shouldnt be entitled to the money from it. And Im unsure as to why the insurance company would agree to pay you the money and not to who the car belonged to? Wasnt up to you to keep the money or even make a claim for it. Did you have private insurance or was your employer responsible for it?0

are you suggesting i received a redundancy letter then disappeared into the sunset with their car!!!???
i was informed by the managing director that i would have use of the car for a period following redundancy. it was during this period that the company went under.

I have read all your reponses (twice) and I am still unclear about your situation. Ill be honest and say I think you are omitting something or not telling us a key fact.
That said, and if I am wrong or right, can I suggest you sack your solicitor and get a new one. You are throwing good money after bad.
When you get a new one, tell them the full story and take their advice. Given your story and the very many questions we all have, I can't see you getting the advice you need, only a solicitor can do this now.

on the basis of your kind responses, i am now of the opinion it obviously was a mistake to talk to the insurance company.
given, benefits have asked for an annual overview of savings ie bank account statements, this next question really scares me.
on the basis i was paid by the insurance company in JUNE of this year, does this mean that (based on the £6k savings theshold), that for EVERY week that shows on statements, that i have been over £6k, i will have to repay £1 for every week per £250 back ie balance between 6 and 10k from june?????
please tell me not :embarasse0 -
i would think so. it's taxpayers money and they will not forgive an overpayment regardless of the reason.0

it was a vehicle bought by the company in full from a second hand car company in london, so it belongs to them0

i don't know what the answer is. all i can say is the company sounds decidedly dodgy and youve become embroiled it in by your actions ( i accept unknowingly)
they will see the money as yours...............and if the administrators come knocking you will have to 'do a deal' with them and pay the insurance money back over a period of time.
i don't understand why you asked for the insurance money.
if you hadn't and the administrators would have had to chase the insurers and not you, and you wouldnt have forfeited any benefit.
