    oncomng police vehicles cant track your speed.
    Target Savings by end 2009: 20,000
    current savings: 20,500 (target hit yippee!)
    Debts: 8000 (student loan so doesnt count)

    new target savings by Feb 2010: 30,000

    They need to be behind you and check your speed over wo different points, for example a house could be the starting point of the check, to the shop down the road, that's two points.

    I warn drivers, recently I have seen six mobile speed camera vans, since the new budget came in - it's obvious they are going to try and catch ANYONE now, due to each council having a limited budget, to recover there budget losses.

    Watch out, never had a camera van parked on a road near me, ever, in 10 years, the other day, one was tucked away between a van and a car! - Be warned!!!
  • I was cautioned at the time an signed it in his notebook that I told them i was doing 40mph. Is speeding classed as driving without due care and attention tho ??

    They would only need that if they were using the vehicle's speedo plus the opinion of an officer as evidence. In this case, they are relying the opinion of two police officers, who believe the OP was speeding. (Not helped by the fact that he said he was!)

    Wow, who is training these police officers to be able to judge the speed of a car to the nearest 5mph while driving in the opposite direction? Was it Robocop or something?

    Fact, OP admitted the offence, if he was placed under caution, that's all the evidence the CPS require and enough to charge.

    Hence the Caution, anything you say from Caution CAN and MAY be used in evidence, an admission is 'evidence' therefore, OP is in sh*t if he was cautioned, if he wasn't, then it's down to the Police to prove he did say it, although, the CPS often believe officers witness statements over a suspected offender/public.


    Admitting is enough for the CPS to charge, though not enough on its own for a conviction ;)


    The police a pulling a bit of a fast one, due care comes down to their opinion, whereas speeding is quantifiable. More and more common now, but at worst I would make them work to convict, so not guilty and they can waste a day in court. Could get lucky in that the officer is transferred or on holiday etc and the case is abandoned.

    In your position I'd be pleading not guilty to DCA. There's not a lot of evidence for DCA IMO.

    There's a chance that, rather than take it to court, they will drop the DCA charge & offer you 3 points & £60 fine for the speeding you have admitted too.
    Always try to be at least half the person your dog thinks you are!
