    don't close your claim!
    if an overpayment has occured, simply stopping your claim for a few months will NOT get rid of the overpayment.
    talk to hb/ctb and explain the situation.
    you may not have an overpayment, but if you do, closing your current claim will not be the solution.

    You dont need to close your claim - the money is in your sons name given to him by his grandfather. The fact that you are a signatory is irrelevant, you can prove that the money came from a gift and therefore is not yours.

    Even by your own logic the £3400 would still be under the £6000 limit so youy would not need to do anything.

    Ring the CAB on Monday but the publication I quoted from is just what they will use (yes I really am that sad!)

    Children's savings are ignored, the rules changed in April '05. In fact most LA forms don't even ask about children's savings now, ours certainly don't and haven't done for years.

    The fact that you are a signatory on the account is irrelevant, the money is his.

    The only way in which the LA would be interested in the account is if it was unclear who the money belonged to. For example, if you were having your wages paid into your child's account or paying bills using the money in his account, or if you had savings of your own which you placed in his account. So if you were stating that the money belonged to your child and it was clear from the account history that it was actually yours, they might choose to treat it as belonging to you. It doesn't sound like the case here anyway, but since the savings are well below the 6k threshold, there would be no effect on your entitlement.
