@pinkshoes normal guys like me know when singed a contract he or her have 14 day cooling off period i.e : mobile phone, internet , sky , bt etc incl onsite or offside "virginactive & davidlloyd offer 14 day cooling off period on or off SITE "
this is unfair contract, all i wante to see what offer my local gym is going i end up pressured into signing up for a 12 month membership.
that was stupid off me sing so think i can't pay & dont need.
Please keep give me your advice every comments are welcome
Well I hate to break it to you, but we're all normal folks on this forum and if you search you will see numerous "Help get me out of this gym contract" threads!
The "Get me out" clause's are not offered by all companies. For example.. Sky will charge you £120 if you cancel within 30 days!
Also cooling off periods only apply if:- For agreements signed away from the creditor’s normal business premises – i.e. at your home, place of work or at an exhibition stand
- For agreements made at a distance (online, by phone or by post)
Edit:
Also Virgin active's cooling off period doesn't apply if you use the facilities!:exclamatiTo the internet.. I need to complain about something!0 -

I think, as said you will find from other threads this is not the case when you sign up on the premises
1st i have not stick or accept the T&C - the T&C was not show to me before or after i singed
Did you ask for a copy of the Ts&Cs - would you normally sign a contract without being fully aware of what you are signing?
2th the saleswoman never told me that i have't got a 14 day cooling off period.
There is no cooling off period if you sign on the premises- Did you ask the question?0 -

They may well do so, but they are under no legal obligation to do this. Their 14 day cooling off period is an additional service given to their customers.
As to not getting a copy of the contract, this was an error on your part. They would have given this to you and explained about the lack of cooling off period if you had simply asked about this before agreeing to a 1 year contract.
Your biggest mistake was cancelling the standing order as this left LA fitness no option but to hand the debt to a collection agency, and the only way to sort it out now is to either pay the full amount or refuse to pay and go to court where you may well end up with a CCJ against your name.0 -

My advice is to stop wasting your time looking for excuses of why you were pressured, and just pay the money owed. There is NO WAY out of this, so stop looking for one, as you'll only end up getting into more financial trouble.
Unless you're saying they held a gun to your head and made you sign?Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0 -
You will have to pay so you may as well use the gym. You clearly liked it enough to sign the contract.0

If you are really clever, you can argue that the copy of the agreement was the agreement in its entirety - and if separate Terms and Conditions are not mentioned explicitly, then they do not apply.Once sign-up was complete I was given a printed copy of the agreement but NOT the terms and conditions.
That might allow you to cancel at any time [but not retrospectively], regardless of what the Terms and Conditions say.
But you really need to be on the ball to pull this one off - and the tale of how you got into this situation indicates you might just be better off paying up.Hi, we’ve had to remove your signature. hi Sebass
"pinkshoes" talks like the contract is about morality.
nobody is being hurt if you cancel the contract. this is the first thing to understand. the contract is just a tool to get LA Fitness to make more money.
now to answer the question as nobody is helping.
you can cancel easily by saying you are leaving the country or you are ill.
This requires (1) Written Email
(2) Written Letters, one to head office and second to local gym
(3) Repeat this again and again until they know who you are.
If that fails a method used when i was at university outside fitness first was to hand leaflets to people about the threats against you OUTSIDE the gym. after about 15minutes of this the manager will notice and first get angry and speak to you. you explain what you want and it works fine.
Legally can you hand out leaflet if its OFF the Premises of the Gym. This can be therefore done on the property owed by the Council or whatever.0 -
the other option is also to SPAM the facebook groups of LA Fitness.
A lot of these companies use Twitter and Facebook for some minor promotions. spamming them with multiple acconts on facebook will get you noticed.0
