Court cases

I know its a fact that ppc's don't do court but I can foresee a time when they might start. This will start to happen, imho, just after the clamping ban comes in (if it does). The sc****gs won't like losing their ill gottens so I fully expect them to start issuing court papers, either real or fictitious to make up for it. May I suggest that we all keep any papers filed away to ensure that we don't have any nasty surprises next year.
Also what would happen to any clamping tickets if the demise of the SIA comes before the clamping ban? Would they all become illegal?
Governments are not noted for joined up thinking so I expect fun and games for a year or two.
Or am I just too pessimistic and paranoid?
I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.

    May I also point out that those who have done court have either won due to default judgement (a defence not entered into), in rare occasions won (some claim the handful of cases were in fact a setup by Perky, but more often than not if a proper defence is made either the PPC mysteriously drops the case or when it goes to court they lose. PPC's are known to come on here and give surnames of radio DJ's and their hometowns and footballers as fake court cases they pretend they have won.

    If they do start going to court however, it will highlight the legality of the charges if over 80% of the cases go against the PPC's. At that point either the law will change, or the charges will be banned outright. Depending on the law change it could then be a long battle like it was with clamping for an outright ban once trthe Government realises it's done not to control parking, but make money and victimise people - and like with clamping, regulation does not kerb the cowboys.
  • My point being that most "transgressors" will fold at the first sign of the "court" papers. How many folded at the sight of the false papers given out by that firm of solicitors?( was it Whyte??) before the judge started to take an interest. It takes a lot for most drivers to fight a court battle and most don't have the advice given by MSE and pepipoo etc.
    I just wanted to highlight the thought that Ex clampers are likely to move onto this line of attack and not to bin all junk mail from ppc's.

    I don't see any difference in the letters sent north of the border, where clamping is obviously already not an option for them. However the companies in the south do seem to be a bit more aggressive in their approach and a bit more widespread. With any luck, you will find more of the sharks moving out of the game rather than an escalation of the current situation. Certainly they must find Scotland less profitable, as we don't suffer the same level of harrasement from these companies, or maybe our drivers are more considerate where they park ;)

    If people have filed them in their bin or using them to light their fire & these xxxxx want to take the court route we can still get a copy of everything they have on us using DAta Protection for £10 inc p&p and don't forget that it should include all types of images, video & still. So if you are in a car park for 2 hours & they say they have caught you on CCTV you get 2 hours of video.

    And by the letter of the law for video they should pixelate the video if it catches other people or information that could identify other people. Now there is a nice job for someone!!!!!!!!

    Of course the best defence is the one my wife has, she wasn't driving her car at the time.
