I think I have been supplied a jailbrake Iphone on contract....... Help!

Good morning all!
I work for a small business and we have recently taken out a new business contract on our mobile phones. Everything was going fine until the switch over yesterday and we encountered our first problem on our IPhone.
We got the Iphone 3G, we plugged it into the computer where this requested us to upgrade the software, as you do we accepted. After half an hour of the software upgrading an error message appeared that stated that the SIM is not supported. After this we have been unable to use the phone.
I rang the company last night after the customer advisor went away and checked he came on the phone and stated we should never upgrade the software on this phone. This set alarm bells to me as, isn't that what you are supposed to do with the IPhone?! I left it at that as he is sending out a new one once he has received this one. I now have lots of questions to throw at the guy (My partner is very tech savvy and said it sounds a little like it could be jailbroken) Also another point that may be useful is that when my colleague opened the box there was no plastic cover on the phone like you usually receive on any apply product!
Basically now I want to know where I stand, are they allowed to supply us with a jailbroken phone without us knowing?
Any advice would help me a lot and get my facts straight from the beginning when tackling this matter!

unless you explicitly have a contract for second hand phones from this company you should request phones be supplied new with original unmodified Apple software on in 'new' factory condition, the phones should be in a condition where they are able to be fully supported with standard offerings/updates from apple.
If they're failing to do that they are not performing their end of the contract, god knows what kind of modified / stolen / dodgy second hand phone they are supplying otherwise.
stop using the word jailbroken, that is something compoletly different and you clearly have no idea what you are talking about there.
perhaps apple can offer some advice too.0 -

Jailbroken is the term that someone else has stated to me, this guy works for a network so I presumed that he knows what he talking about, he is also a familiar name on these forums. You didn't need to be so rude and make me feel stupid on a public forum.0 -
If you stick to the 'consumer'/contractual side of the issue I'm confident you'll be well placed to make progress that way, certainly if you present Apple and/or a reputable UK network operator with the situation of a 3rd party supplying their contracts with dodgy/modified/second hand phone handsets being passed off as new and legitimate they'd be interested.
Are they able to offer a full explanation in writing of why the software cannnot be updated as per manufacturers standard recommendations, what has been modified about it and what approvals do they have from apple/the network operator to supply handsets modified in such a manner.
have they implied any warranty with the phones? or made you aware if they have deliberately invalidated the manufacturers warranty by modifying the handset?0 -

If it was a jailbroken phone, you wouldn't want to update the OS...0

if the phone was jailbroaken the update would still have worked but you would have lost your jailbreak, that is why you are told not to update a jailbroaken iphone. it will be a different problem if the phone will not update at all or breaks at update.
OP where are the phones from? a legitimate network? or some internet site?
you can try putting the phone in DFU mode and then plugging it into the PC with itunes and click restore, this will fully reset the iphone to new0 -

Wrong. Jailbroken is the term given to an Apple phone running native IOS which has had the copy protection broken and other things disabled so you can install your own apps without going through iTunes Apps Store and use whatever SIM you want in it.0 -
