Attendance Allowance Query

My husband receives dla mobility -higher rate, he does not get any care component. His condition has worsened and he has been diagnosed with emphysema and has severe arthritis in his spine and hips. Would he qualify for Attendance allowance -he is 67 ?

    You could claim DLA care element as he is already on the DLA or you could claim AA but it is unusal to come accross someone with both in payment

    he can claim dla care component as he is already getting dla however there is a small risk he may lose his mobility component he cant claim attendance as he is claiming dla and you cant claim both

    You could have a claim in for both in this situation as the DLA is only for the mobility and the AA for the care side. It does happen

    What ever he does, don't give up the DLA because there's no mobility element in AA.

  • Hi, i can confirm that you would be applying for the Care Component of DLA due to your husband already receiving the Mobility Component. DLA was started in 1992, prior to this you could claim both Mobility Allowance and Attendance Allowance. Since then all new claims aged under 65 applied for DLA either one or both components and over 65 apply for AA.

    This is wrong they will get dla as that is already in payment they will review the dla. both benefits cannot be paid together they are overlapping benefits


    I have seen this happen, where dla mobility is in payment and then the customer is awarded aa instead of the care component, not really sure when this happens and why they do it, but does appear, not often but does appear

    If the claimant continues to fulfil the eligibility conditions for DLA Mobility after age 65 then they can continue to get it after age 65. As far as I am aware you can not put in a new claim for DLA (Care component) after age 65, if the eligibility conditions did not exist prior to age 65.

    Perhaps this is why you have seen people awarded AA instead of the care component of DLA, (after the age of 65); although my own Disability Handbook says you cannot claim both DLA and AA at the same time.

    Fact is: the rules can get very complicated at age 65, if you are in this situation, and you should seek help from a welfare benefits advisor. As someone said earlier if you ask DLA for a reconsideration of the claim, it could put the Mobility award at risk. The rules for mobility are quite strict. The expectation is that people will become less mobile as they age and that is why Mobility is not a component of AA.

    I thought this was only for the mobility component?

    my aunty has been on low mobility component only since she was 63 this year she was 67 and now has problems with breathing etc she needs 24 hour home oxegen therapy she asked dla in blackpool for a review of dla to get care component and got awarded high rate care compont of dla and low rate mobility of dla awarded indefinatly just looked at the award notice and is deffo dla not AA
