RTA PI claim - 3rd parties insurer not reponded..what next?

Hi, i hope you can help us as we got some very useful information and advice initially reagrding this matter.

In a nutshell my mother was involved in a RTA -early 2010, She had/has injuries and has attended a medical that sattes the injuries are a result of the RTA, she is also attending physio via her GP for this.

Her solicitor put the report to the 3rd parties insurers about 10 weeks ago and so far they havent responded. Her insureres say that they are just in the middle of issuing court proceedings and had written to the other parties insurance company requesting their clients details etc but have had no response so have said they will call the other insurance company this week to chase to see what is going on as they have a reputation for being very slow. The other party have admitted full liability etc

My mother has been driving 40 years and has never been in an accident or persued a claim for monies due to an accident so is at a loss as to what is happening next..shes not very 'forward' so didnt press the insurers to se if that meant they were going to court or if they were simply trying to put pressure on the other parties insurers to review the case.

The driver was very abusive to my Mother at the time of the accident and has been since (she saw the other driver whilst shopping some time ago and they were quite abusive towards her regarding the RTA) So my mother is now in a state thinking she must go to court and face this person in a court room infront of a judge etc. I have tried to reassure her but i cant as i have never been in this situation either.

So, basically does anyone know what will happen? Is it simply a way of getting the insurers to respond or will she have to go to court? If she has to go to court will happen on the day? Finally, how long should this process be expected to take?

    There will be a long way to go before this ends up in court (if it ever does), so tell her it's too soon to start worrying.

    This process can take years, certainly months and not weeks, but to answer all her queries she should contact her solicitor.

    I think i shall ask her can i speak to the solicitors on her behalf. She is quite a timid woman and sees asking questions of 'professionals' as rude. She cant grasp that she is the client, and can ask what she wants when she wants.

    So do you feel that this is unlikely to go to court?

    It really is impossible to say without all the facts. Some PI cases do end up in court, though often the threat of legal action is made to "concentrate minds" on getting a resolution.

    You need to contact the solicitors to find out why legal action is threatened and the likelihood of a hearing being necessary.
  • Thanks for that. The reason they were asking for the info to commence legal action was due to the fact the other parties solicitors hadnt responed to the medical report and level of compensation they attached to the injuries. Apparantly they have so many days to do this and this deadline expired some weeks ago. Again thanks for the assistance. I am going to try and speak to them on mums behalf later this afternoon so she has a clearer picture of whats happening.
