Brought Item now faulty, but shop says it works fine

Hi, hopefully someone could give a bit of advice please.

I brought hubby a guitar hero pack (with game and guitar). After 2 days (maybe 4/5 hours of usage) one of the buttons stopped working.

I took it back to the shop and told them. They decided to test it instore and told me it worked fine and they couldn't replace it. I asked them to show me in store and they did.

As soon as we got home and tried it again it worked for a few minutes then stopped working again.

We also tried it on a second console and it still didn't work. We then used an old guitar hero on the console and that worked fine, so really don't think it is the console.

I contacted Activision who said I could apply for a replacement. This is fine, but as I brought it from a shop and it broke within a couple of days, surely I should be able to take it back to HMV.

My question really is how do I go about doing this if they still refuse to accept it back.

Any advice is greatfully recieved.

    Unortunately as far as they are concerened it does.

    Nothing worse than intermittent faults to get sorted out. Hopefully it will get worse and you can go back again. This is one case where you musr really remain calm, if they can't replicate the fault then if you sound reasonable hopefully they will sort it out.

    I have printed out a copy of the email from Activision which says I can get a replacement and also a copy of Martin's rights guide so hopefully I can argue the point (calmly) that as I purchased from them I should get it sorted from them. If Activision are willing to give new guitar, them surely HMV should?!!!!?

    What about taking your console to the shop with the older copy of the game? They might spot the problem then, perhaps a software upgrade will solve it.

    How long do you have to have it running before the problem occurs? Does that make a difference?
  • Thanks to you both for your input. I got the shop to give a refund. I went in armed with paperwork and was extremely polite but they didn't have a problem at all and just refunded (I went to a different branch than yesterday)
