marriage is over

hello everyone first post.

my husband and i are spitting up,i just wanted some help s to what i am entitled to.

i am over 25
have 3 children 16 15 11
i get dla middle rate care and high rate mobility

i live in house that is joint mortgaged with the husband

i dont work as i gace up my job many years ago due to my illness. could any one please advise as to what is my next step

  • I am sorry to hear of the breakdown of your Marriage, I think you should go and see your local citizens advice who can bestadvice you knowing the full circumstances. You will presumably already be getting Child Tax Credit and Child Benefit. Are you still living in the Maritial Home? Do you currently receive any sick realted benefits yourself? Sorry I can't be of much help :-)

    I am sorry to hear of your breakup - its never easy.

    For yourself, you will be able to claim DLA with the possiblity of an income support top up, child tax credits, child benefit, you may get help with your mortgage.
    Does your husband work? If so he will be liable for 25% of his income to be paid to you in maintenance for the children. If not then he will be assessed at a flat rate of £5 a week until he gains employment.

    As has been said really you need to get some support to help you claim your entitlements and ensure that they are put through quickly. You can apply to your local job centre plus and ask to speak to a lone parent adviser - they are brilliant, and will ensure that everything is fast tracked for you. You can get an idea on www.entitledto.co.uk but help is definitely the best way to go.

    Lastly you are entitled to remain in the marital home until your youngest has completed full time education (so at least 18 and possibly 20) so please do NOT move out. You will also be entitled to a more than 50/50 split of the equity in the house and a proportion of your husbands pension should he have a private pension.

    Go and see a solicitor to understand your husband's obligations towards you and his children.

    The Shelter website gives basic info for home owners on their relationship breakdown section.

    The Turn2us website is a handy online benefits calculator and can give you an idea of the tax credits, council tax discount, income support, etc, you could be due as a single parent.

    i do already get the child benefits and ctc in my name. i receive no other income just my Dla.

    i didnt think i was able to claim income support as a lone parent anymore. would i have to go on the dreaded ESA

    husband is in employment all be it on a low wage
