Title Deeds of house were buying are lost what now?

  • The deeds to our house were lost back in the mists of time - it had been empty for 30 years and left to rot by its absentee owner who had never even registered it! I'm afraid it took a long six months of legal wrangles about proof of ownership etc. before it was finally ours. Not something I ever want to go through again, but of course it was worth it in the end as we got the house for a ridiculously low price.
    Hopefully your wranglings wont be as complex as ours.

  • well contacted our solicitor and we are all pushing for completion on the 27th as long as we can get into the new house. fingers crossed and thanks everyone.

    The deeds to my house had been lost when I bought it but the property had been registered with the land registry some five years earlier.

    This meant that I was only able to get the freehold as a "posessory title" and had to take out the insurance which other posters have mentioned. The sellers footed the bill for that and it was about £150. However, after 12 years (I think) I was able to convert the freehold to "absolute title". The insurance was then no longer required and I now have no problems. (That's 12 years after registration, or about 7 years after I bought it.)

    its simple really - dont know why your solicitors havent suggested it - you just need to get the vendors to take out an indemnity policy in your favour, shouldnt cost too much either - depends on how much the house is worth.

  • as far as i am aware the land is registered and the solicitor at the moment doesnt see any big problems with completion. (touch wood)
