I doubt it, but under the sales of goods act or long distance selling act you do have the right under law for a 7 day cool off period. so basically DON'T open it and send it straight back with a covering letter. best to look on the shops website for what exactly to do.
you could also ring the company asap to explain and they may be able to cancel the delivery - but you are still covered by the cool off thing.
but if you bought it from a store for home delivery then you (afaik) you have the same rights as if you just collected it from the store when you bought it0 -
Erm if he ordered the TV in a shop for delivery the DSR almost certainly won't apply (the key is in the Distance part of the rules), especially if he had a chance to see one in the flesh and booked delivery for convenience.
The SOG doesn't give him much of a foot to stand on either as I understand it as the TV isn't faulty.
If ordered in store I suspect he's reliant very much on the store policy, in which case the best bet would be to try and cancel it before it's delivered.
I'm not sure what his best bet would be, possibly to ring the store early and see what they say - he may be able to refuse delivery and just pay delivery costs, but if bought in store the rights to cancel before delivery are I believe much weaker (DSR was there to allow for buying goods where you didn't have a chance to see them at all via mail order and internet, not bricks and morter).0 -
Well, you can certainly not take delivery.
It may be that the courier's policy is to return it to sender after 2-3 failed attempts.
I don't know where that leaves you in terms of payment/refund though.0 -
yup, had he looked it in the shop, then left and ordered by telephone or online he'd have a 7 day cooling off period, but ordering in the shop you don;t have any automatic rights and are at the mercy of what the shop's policy is (ie they don;t have to let you cancel).
If you refuse delivery they are perfectly within their rights to keep your money (and likely charge you again for redelivery)0 -
Correct, no legal right to a refund whatsoever just because you have changed your mind. Purely depends on the shop's own returns policy. No free lunch, and no free laptop0

Have rang up the shop. Been told to refuse order. Courier may attempt to redeliver again. If not the money will be refunded in a week or two minus delivery charge.
