Parking fine?

I was in Winchester 2 weekends ago (22nd - 24th September) for the Motocross of Nations and had gone into the local town to get some food and drink due to the unbelievably high amount they were charging on site (£4.50 for one of the most disgusting burgers I have ever tasted). I found a quiet street in the town near the shop I was going to go into and as there were no parking restrictions (double yellows or signs) and other cars were parked on the street I thought it was ok to do so.

I was only in the shop for a maximum of 15 mins before getting back into my car and driving back to the site. I had jokingly said to a mate I better not get a PCN before we got into the shop and had made a joke of checking the car on our return to see if one was issued, as expected there was nothing.

Today in the mail I received a letter from Winchester City Council saying that a PCN was issued on my car on the 23rd of September which has yet to have been paid and that the 14 days has now expired on it (letter dated yesterday and 14 days would have ran out on Saturday) and I now have to pay the full £60. There was nothing on my car at the time and in the past when I have had a parking fine (2 this year) I have sent the cheque straight away to avoid problems with bailiffs, court, etc.

Now somewhere along the lines the PCN has been issued on my car and been stolen, the PCN was never issued and some traffic warden is being a **** or some other mysterious curstamencances are surrounding it. Does anybody know where I stand about paying it if it appears to have never been issued?

All of the information was correct on the letter esp Reg no and the street I was parked on. Should I ask to see the photo which (I believe) the traffic wardens are legally obliged to take when issuing a PCN?

    You could ask to see the photo, but you know you were there so not sure what help that would be. I have sometimes seen our local wardens taking pictures of the parking notice as well and that seems to be what you actually need, confirmation of what those restrictions were. I think you need to write to them telling them that there was no notice on your vehicle and in addition, despite checking, you could find no parking restrictions.

    Perhaps if you were to actually name the location you parked, someone on here might know it and know whether there are restrictions or not.

    Bayliffs have apparantly been round but we werent in!

  • I would pay the fine before i did anything else,once debt collectors get involved you could find yourself well out of pocket.once you have paid then try to appeal the decision.

    my sister has been fined for not having road tax on a car that has been scrapped, although the paperwork was sent off to the dvla ,they say it is her fault,you could not make it up.:mad:

    Ask for a photo and a copy of the ticket. Explain that you never recieved the ticket and have not had the chance to pay the reduced rate. It is likely that you was seen by a warden and you drove off before the ticket was issued.

    If you drive off before ticket is fixed on car or given to you, the ticket is invalid & should be cancelled later by the warden.

    A ticket is not valid unless it has been served by fixing to car or given to driver.

  • Call AND email the council and state that NO PCN was attached to your vehicle. Get this on record as soon as possible. Also ask for the restrictions details/times for the street you parked on that day.

    Ask to be sent photographic evidence, but bear in mind that if the PA did not take any photos as long as the PA got your tax details the council can still push the ticket, cause it proves you were there.

    If they do send pics with ticket attached to your vehicle, again state that it was not there when you got there, they should reduce your ticket to the original price. Hence they should refund the difference between the original cost and the increased amount as you were not given the opportunity to pay the reduced amount.

    There are options avaliable to fight this if you really feel strongly about it, all depends on what information the PA noted.
