Sanction put on benefits by misstake

I found out this morning that on feb 2009 a sanction of £10 a week was placed on my benefits due to failure to attend a work focused interview. However the records show I did attend the meeting so the sanction was an error and I have been told someone will call me back later today to disguss the arrers.
My question is will they pay back the entire 22 months of arrears? Or am I right in thinking they will only pay back the past 3 months worth?

    I must admit that was my first thought too. All I can think is that the OP was fairly new to benefits (or at least the benefit they are claiming now) and just excepted what they were given.

    If i was getting 65.45 per week and they deducted 10.oo from my benefit pretty sure it wouldnt take me 22 months to notice it.

    Sanction should last only 26 weeks maximum.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    With the sanction being in relation to a work focused interview it may be a claim for ESA which is more than JSA.

    If it was my claim I'd have known the payments were incorrect but just thinking back to when my hubby first got awarded ESA it was very complicated when premiums were added.
  • Going by the experience of a friend of mine at the moment I think it would be very easy to not notice if it's an ESA claim. She's been getting paid ESA for the last 4 months and she hasn't had the same amount twice so far!
  • £10 a week sanction sounds like an Income Support WFI sanction.

    In which case they can be indefinate until the customer attends a WFI.

    If it was entered in error they they should and will refund the entire period you were underpaid.
