Claiming on car insurance with no MOT

Hiya,
As the title says, can you claim on your insurance if the MOT has run out? I know it invalidates your insurance but i've been having a discussion with someone at work and she says you can still claim if the car has been stolen. I think she's wrong but i thought i'd ask here before i start with the told ya so's!

It does not automatically invalidate your insurance - though many insurers do have clauses which means it does invalidate it. If the vehicle was off the road then the fact it had no MOT has nothing to do with the loss and therefore couldnt be used to repudiate the claim.

Even if they do accept any form of claim they will reduce the market value of the vehicle when considering if it is a total loss or not

The small print will decide whether you're covered or not &, like mine, it's probably a bit ambiguous as it says 'Failure to .....not have an MOT..... MAY invalidate your cover'. This covers the insurance comapny so that they can decide on the day whether or not to pay out. It doesn't distinguish between accident or theft, though you'll probably find a car thief could sue you if the car stolen is not in a roadworthy condition or you haven't got a sign on it saying there's no MOT (just kidding on the last part (I hope!!))
