Eligible for a claim under section 75?

Hi all, I'm new to the forums & would like some advice please.

About 3 weeks ago I visited a private dermatologist and paid for some prescription products, which I'm still waiting for. After being told the items have been posted and "should arrive soon" they have been very difficult to get hold of for an update (left messages with receptionist asking for call back, heard nothing).

I have the receipt, but it's not itemized and a portion of the payment was the initial consultation fee as they take 50% upfront as deposit, and the other half is paid after the consultation. I paid for it all with my Mastercard. Would I be covered by the credit card company for the products in the event of a claim?

Any advice appreciated, thank you in advance!

I don't see why not if the amount was over £100.

If the products in question i.e. the prescription not the consultation is over £100 and they don't get delievered then yes, but most card comapnies expect you to have exhausted every avenue with the company first.

They might also be covered under the post office compensation scheme but I believe they have to claim and not you.

If the prescription products are standalone they 'theoretically' would have to be over £100 each to meet the requriements for Section 75. If however they were sold as a bundle you should be OK (assuming the total cost excl. the consultation fee is £100)

Credit Card companies may expect you to exhaust contact with the supplier, but, if Section 75 applies they cannot legally make you do so as they are jointly liable with the supplier, it is however easier to do so in the 1st instance, as it can take a while claiming from the card company(assuming you have to complain to the Financial Ombudsman in order to get them to pay up).

The Items may be covered by the Post Office compensation scheme, which either the buyer or seller can claim for (assuming you have a copy of the proof of posting) , maximum claim £41 (100x 1st class stamp).

None of the prescription products cost over £100 individually but together they do, and were bought at the same time, which should count as a bundle? I called them 3 times last week, and once yesterday, left message with their receptionist, was told the assistant would return my call when available, but didn't. Will give it till end of the week before starting the process.

I phoned my credit card company, Egg, earlier and was advised to send off this form new.egg.com/visitor/0,,3_112067--View_2437,00.htm Do I need to mention section 75 on it?
