I have been made redundant....

As the title says really.

I'm lost as to how I can get my redundancy and notice pay.

I went through all the legal proceedings to try and get my money but after getting my judgement certificate from a tribunal I was told my options were to send the bailiffs in to take things that can be sold at auction to pay the costs to me. After doing research on this I have found out this would be pretty pointless because the bailiffs cant take anything that would be needed for work and that he has 28 days notice before they would come (to clear out anything that could be taken away). I could freeze his bank account, again though 28 days notice (to take out his money and open or transfer to another account).

My employer has no interest in paying me and it seems he is right because I really dont know how I can get my money.

I thought redundancy was a legal thing and that they had to pay.

Can I not take him to a small claims court. Through all this he is still trading.

I've been told I can wind his company down but I really dont know anything about this type of thing.

Is there anybody that can help please.

  • If you are owed more than £750 either you can make your employer bankrupt if he is not a limited company or wind the company up if they are. Obviously by threatening bankruptcy you would have a good chance of getting him to pay.

    If the company is limited then the only way that you will get yout money is to formally wind the companyup and then make a claim from the national insurance fund. This can be a costly and time consuming process and you would need to work out what you would be likley to recover to see whether it will be worth it.

    https://www.direct.gov is a good place to start or talk to your local court about the neessary steps and the cost.

    Thanks for the reply, the company is limited and the amount owing is alot more than £750 so i guess i will look into winding the company up.

    You need to issue a Stat Demand.
