27th October deadline letter

Hi there,
I am in the process of trying to claim back PPI payments from Virgin Credit Card. I am at the process of MBNA investigating the claim. They sent me a form which I filled out. I was initially knocked back after a phone call regarding the PPI in July, which generated a letter from Virgin. I then sent the first letter to them.
A couple of weeks ago I received a letter from MBNA explaining that they are investigating the claim and will get back to me by 27th October 2010. To be honest I didnt think anything of it. Until I thought what a strange date, subsequently trawled the internet and found the significance of that date (the extension for old claims). But I am a new claim.
What I am wondering is, should I be contacting the FOS? Is this a clever tactic by MBNA to avoid paying nothing or even the full amount.
If anyone out there can explain to me, what should I do.
Cheers Bazzer

Hi and welcome
Sorry If I have mis-read, normally they have 8 weeks to investigate complaints, sometimes they ask for more time, if 8 weeks have passed and you hear nothing you do have the right to make a complaint to the FOS, the same if you receive a decision your not happy with.
Good luck. The one and only "Dizzy Di"

hello DI
Apologies if I didnt explain myself. I thought that about the 8 weeks but it puzzles me about MBNA stating that I will hear from by the 27th October 2010. As the 27th is the cut off point for people who were intially rejected for claims in 2009/10, the FOS gave an extra six months for people to enable the FOS to take up there claim.
I am worried that if they contact me on 27th or after I will lose out on claiming or am I misunderstanding the 27th October deadline.
Their letter states:
"Thank you for your letter regarding your Virgin Credit card, which is issued by MBNA Europe Bank Ltd.
Please accept my apologies for the delay in responding to you, however our investigations are taking longer than anticipated. We will issue a response by 27 Octber 2010".
Then take on board the FSA ruling:
"The FSA announced a temporary rule to give customers who recently made a complaint about their purchase of a Payment Protection Insurance policy more time in which to refer their complaint to the Financial Ombudsman Service. The rule suspends the six month time limit for referring complaints to the Ombudsman and will run for five months until 27 October 2010 and applies to PPI complainants who have been sent a final response from a firm between the dates of 28 November 2009 and 28 April 2010."
Now my claim is after 28th April 2010...so why mention the date in the letter. All quite strange.0 -

Hiya
I understand they do tend to send out letters and also give their own timescales, and this would be the middle of next week then I take it that you should hear?
What you could do is give the fos a ring for reassurance, at least this way you've had their own word for it, but try not to worry, it will work out either way.;)

Ring them just as a general query, I'm sure all is okay here.
