  • Sorry greendollar, work has been really busy for me and home internet is awful.

Gosh, I am sorry to hear your case is going on for so long! Do you mind me asking, how have you coped? I am really struggling and I only put my claim in at the ET in May. It feels like a long time but it is relatively nothing compared to how long yours has taken.

It's awful. I cannot wait for it to be over and I feel I now need to learn how to put it at the back of my mind so much - but it is very hard.

    Any tips would be great!

Also, any other awful tactics I can expect?

Thank you! down but not out (yet)
  • Hi DBNO ,

How have I coped ? I don't know , I'm really gobsmacked at the tactics my ex-employer and their solicitors have used but I have found out that they're quite common .
In my case the company are huge ( employing 80'000 + in 120 countries) and defending my claim is something they can afford to throw money at I suppose .

The threat of costs are widely used and put many off from seeing their claims through .
They've had numerous requests for costs, deposit orders and wasted costs orders refused .(doesn't stop them trying though) .
They've even gone as far as to manufacture (basically lie) an excuse to try to con the judge into granting an order for costs .

They've attempted to omit ALL my evidence from the bundle ( another common tactic) ,twice, thats the danger when your employer is responsible for the bundle . Go over it with a fine toothcomb and complain to the Tribunal if they mess you about .

Their excuse to the Tribunal for leaving out my witness statements was that they didn't know the witness statements I'd provided were the ones I wished to use . ????

They accused me of trying to ambush them at the Tribunal with new evidence but I could prove they'd had all the documents for well over a year and a half , and is even mentioned my ET1.

They do all this and more , state I have zero chance of winning but seem very reluctant to actually attend a Tribunal coming up with excuses which the Tribunal service accept every time and postpone .

Still , I beleive I have a very solid claim and I'm not going to let them get away with the way I was treated .

Good luck with your CMD , its all quite scary isn't it but stand your ground and show your no pushover .
